    Hello. I am fairly clear with the BOE process and am ready to send out my first one but I am a little unsure of a couple of things. I received a fine through the magistrates court on 8/8/23. I attended court via zoom link so did not get any court orders. They have not been sent to me either. I did though last week receive a statement from Fines Victoria. Now I have been told I make the BOE out to the Magistrates Court. If I do this how does Fines Victoria know I have paid? Also can I register the BOE to the Magistrates Court and is the registered mail slip a receipt of them receiving it or do I have to hand deliver and get a receipt? Thank you. Linda ☺️

    Have you had any experience discharging debt for smaller things such as parking meter fines? Yes the registered mail receipt is proof of delivery. Here is a screen shot of a BOE addressed to a court.

    Thank you Morag. I really appreciate your assistance. No I have not to date but have watched Mark’s webinar on this process a number of times. I have purchased my linen paper and stamp pad etc so I can get cracking on this one. My fine is for unpaid dog and cat registration. I did everything I should have in an attempt to have the case dismissed such as putting the informant a notice and also sent the courts an affidavit etc. but everything was ignored, the case went through and the judge found me guilty even though he never contracted with me. I have lodged a complaint with the judicial commission and also IBAC. Today I collected a transcript of the court case so I can persue it further. Nonetheless I now have received the fine but as I mentioned am yet to receive court orders. Am doubtful I will, Kangaroo Courts. So this is my first attempt at having a liability discharged using the BOE method. A friend who is also a member here has been assisting me as well so am fairly confident of the process. I live out of town and it would be far easier for me to post the BOE to them. I have been told once accepted by the Magistrates Court I send through the receipt (which would be the registered mail acceptance) to Fines Victoria. Just like the court case am doubtful that it will be accepted and can only presume that I will be hearing from them again. Would it pay to put a letter in with the BOE or is it alone sufficient? I am currently going through the ‘holding my position’ section/module as I am sure I will be required to do just that. I will keep you informed of my success. Thanks again Morag. Cheers Linda 😊

    Hello again Morag. I see the Q&A you sent through answers some of my questions. I will print out and read better a little later on. So the fact I have not received court orders suggests there is no contract, is that correct? If so do I need to request them from the court? I will consider purchasing the package to assist as it will help me get it completely correct. Thanks again 😊

      It has some great examples in the BOE module and gives you lots of information on the BOE Act and the relevant sections. It also has examples of Notices that you can use as templates. It also explains when a BOE should be used and lots more. It’s really worth purchasing relevant modules when youa re wanting to competently complete any process.

      If there is no court order it seems you have just been given an offer of a fine, so it is up to you what you do with that offer.

    Well that is interesting with regard to not getting a court order. I do suppose I could just decline the offer but think I will go through with the BOE. It will give me confidence to perform it again if I should find myself in a similar situation. I will purchase the BOE package as the more information I can arm myself with the better.
