    Drafting a Notice & Demand for further and better particulars and I want to add a D&L clause to add pressure onto police to release my automobile waiving the release fee

    However all of the D&L clause templates I have access to seem to be tightly associated with a Bill of Exchange (admittedly I lack knowledge when it comes to the topic of BoE).

    Q’s:
    -Can I add a D&L clause to demand notice without going down the route of BoE, or is D&L clause inherintly a part of BoE?


    -Should I add a FEE SCHEDULE Instead of D&L clause? (how would you explain the difference between the 2?)


    -Would you say that a D&L clause is more effective to add IMMEDIATE PRESSURE onto authorities to do what I want? (if D&L clause is inherently a part of BoE [which police will know nothing about] I imagine that they’ll disregard the clause altogether and let the matter proceed to court, when what I want is for the notice to convey to them in a way that they understand that it is in their best interests to release the car to me ASAP). 🙂

      We have sent a fee schedule with our first notice & demand . A member of this website shared a pdf with us and some time ago I found another fee schedule example. We made our own fee schedule notice combining the two examples. I have attached the two pdf files. Hope that helps.

          I don’t remember where I found the example ‘Schedule of fees’ and I don’t know what that means.

          We just left this part out since it did not apply to us. We also left out the second page. As signature we used instead: Best Regards, without dishonour, ill will or frivolity,

          I believe ‘Galactic Emissary’ was the way the man who created those documents referred to himself as I think from memory he believes aliens planted us here. However he is an honourable guy and he knows his processes. The default and liability clause is describing the penalty if they default on the agreement once it has been made between the parties. So you can put what you want in it, it doesn’t have to have anything about a BOE etc if that is not part of your process.The d&l within the notices ensures they have agreed to that as well and it not only puts extra pressure on them to do the right thing but also enables you to send them an invoice if they choose not to do the right thing (that is, comply with the agreement established by the Notices).

            The difference between a d&L and a fee schedule, is the fee schedule is the charges for your time and services and the d&l is the penalty they have agreed to pay if they do not honourably comply with the conditions they have agreed to within the 3 step process..
