    Hi all,

    Has anyone ever had any success against the fines enforcement registry in WA, getting fines dropped and or licence reinstated?

    After I provided 3 notices and even offered to pay for the times I acted as trustee in court 3/5, before what I know now. I still haven’t received any form of response to the matter and I’m now thinking the next best bet is to write to the minister for transport stating what negotiations have been reach by the FER and that they have the power to reinstate the licence, even provide them with plenty of case law. Is it worth doing this even offering to pay the times I did attend and get found “guilty” should I bring taking them to court into it if the matter cannot be resolved.

    All advise I’d appreciated.

    I would keep evidence of the agreement you have established in the car ready to show to any ‘authority figure ‘ who demands to see your licence. Do you need your licence for work? It might be worth contacting the common law guys to see if they will issue you with a licence for work? Just a thought. (In NZ we have a group that issues permits to grow mary jane for medicinal purposes. The group is in a higher jurisdiction than the NZ Govt) Maybe ask Mark what he would do if they didn’t honour the agreement. If you had a default and liability clause outlining the penalty for them if they default on the agreement, then you can send an invoice for the amount to whomever you have the agreement with. Have you completed the fourth step yet? (An affidavit that you send to the party/s outlining what you have done with evidence to further establish that you have an agreement with them. Once unrebutted it becomes truth in law)

      I already hold copies of all notices that have been sent and a mailing certificate. I have not yet completed an affidavit but I can do that when I get home. I do require a licence for work purposes, hence the question of should I now raise this to the transport minister and put them in the spot light as the highest person of the DEPT OF TRANSPORT? I don’t want to go to court intentionally or anything like that. It just annoys me that I even offered to pay for a certain amount given the fact I became trustee and still no response. At least if I throw this at the minister I feel I may get some effort or response I will then start invoicing. Not that they will pay up. Should I even write an email to FER asking them a final time if they wish to take up the offer before raising it higher?

        You can try different things, in most cases they never respond or at least only respond with another offer. If I was dealing with that, I would thank them for their kind offer (sending another invoice is another offer) and then say however we have an agreement in place and I am happy with what we have already come to an agreement on. I would probably also attach the final affidavit to evidence the facts of that agreement being final and established through the three step process. I would then keep all of this correspondence as evidence that I was acting in honour and they were not, just in case they ever require me under duress to attend court for any matter related to this.

    Try and stay out of court if at all possible.
