  • Infringement – Interstate License – Cond Acceptance-no payment

Posted by Laura on January 10, 2023 at 8:33 pm

I have received an Infringement from QLD.
I have “All rights reserved” interstate licence.
Will now do the Conditional acceptance – No payment from the Module 36 – Deal with an infringement fine penalty from a state debt recovery office, protect your license from fines, reinstate your license.

    I have a few weird questions and brainstorming, in blue highlight on the document <b style=”font-family: inherit; font-size: inherit; color: var(–bb-body-text-color); background-color: var(–bb-content-background-color);”>Notice of Non Consent, Notice of Conditional Acceptance and Notice to Cease and Desist. <font color=”rgba(0, 0, 0, 0)” face=”inherit”>Yellow </font>highlight<font color=”rgba(0, 0, 0, 0)” face=”inherit”> is just what I need to change to make the </font>document<font color=”rgba(0, 0, 0, 0)” face=”inherit”> relevant to my </font>infringement.<font color=”rgba(0, 0, 0, 0)” face=”inherit”>

Just double checking, is the statement of account the infringement notice? I’m just sending them a copy
Does it matter if photocopies are in black and white? or should I really do them in colour?
Ill need to print a copy of the infringement notice to send them as the ‘Statement of Account”, and a larger copy of my license with signature.

Yes and you should do them in colour.

        Thank you šŸ™‚

I was also wondering, because I have opened the first letter, should I continue to open them to reply to their response. I can’t really stop opening now because I have opened the first one and I’m asking them to respond.

If you have only engaged by writing across the original document with No Consent equals No Contract, etc. Apologies for opening and sent it back. I would not open the rest, just write on the envelopes the No consent spiel and return to sender without cause of dishonour, each time they come. I engaged with a letter/notice of response asking for answers/evidence to my questions. So I had to go through with the 3 notices and a Default Judgement notice. I wish I knew about the envelope method beforehand. Never again, well at least I hope not for a while. Keep a record of photos of the envelope and video of sending it back.

          All the best.

So instead of doing the notice of Non Consent, Notice of Conditional Acceptance and Notice to Cease and Desist, I could just write on the notice and send it back. I just write the spiel and that’s it?
That would be easier then the 3 steps haha.
And like you say, I am not engaging, except for writing on the first notice no consent equals no contract.

So I write the spiel UNCLAIMED do not accept …. no consent equals no contract……..and apolojise it was opened.
Then send that back on its own. When I receive more letters I can just write on the letter itself and send it straight back.
So I’m no engaging with them and giving them no consent

Thank you so much. You have both been huge helping me learn. I nutted out the forms from the module myself and its so much easier thren last round haha. I won’t do them unless sending back their mail doesn’t work and I need to start the 3 step process. its fun when you understand it.

For anyone Using the forms and following this thread, I found out the possible names of the Director and Registrar for the Queensland revenue office and FAMD. Same registrar for SPER

    The Regisrar: Amy Rosanowski

I have waited more than 72 hours because my fine is going to my sisters house in nsw (I’m in qld). She is my twin sister so she can pretend to be me anyway but she has been busy.

In the apology letter would I just explain:

ā€œI apologise for the late reply, unfortunately I have been away and can only return your letter within the 3 days from when I found it on the 15th January 2022 when I collected it from my mail boxā€

Not great wording but first time I’ve ever created an apology letter for this haha

Has it been opened? If not, write on the back, My apologies, I only just got this letter. If opened, Just a little sorry note saying you only just got it and you opened it up thinking it was something else. You do not consent to it.

It was opened. Can I write that on the infringement notice when I write the rest? or should I really do a seperate note. Should I send a copy of the license since it was opened anyway too. In one of the examples, he mentions that.

I would write over the fine, but a hand written A4 would be good. I didn’t do my license as I wasn’t travelling under that jurisdiction. You do what feels best for you, as there is not just one way to handle it. Stick to your Truth and make them prove the evidence. They must Police with Consent remember.

Hint for next letter is to remember the PO Box number so you don’t open it. I look up all mail I don’t know now.

Thank you. I think I will just leave the license out too then. I also don’t want them questioning why I work in qld and have a nsw license with an address13 hours away. not that it is any of their business where I live and what I do for substance.

Thats a good idea, kind of silly I didn’t think of that haha. Thanks again šŸ™‚

    Hi šŸ˜Šā˜€ļøšŸŒ…

I have a few questions on the unclaimed process again.

1 – I don’t have a car in my name. So once the statutory declaration has been approved and sent and addressed to me, if I send the unclaimed back, they can’t then go ahead and send it back to the owner of the car, can they?

2 – If the fine was opened, do I have to tape the envelope it came in up? Could I possibly send it in a new envelope or would that be tampering with the mail and effect the process?

3 – In the unclaimed examples and templates it mentions the QLD imperial act 1984, would this just need to be changed for each state? I’m guessing so but with checking.
