Purchasing property through trust
Posted by edward-hallal on September 5, 2024 at 10:33 amHi all,
was hoping for some direction. I have had a trust through Solutions Empowerment for a while now and I am wanting to purchase a property but would like it to be owned by the trust. Can anyone advise on the process for this and what measures I need to take.
Thank you

Hi Morag,
Thank you for sharing that document. In regards to the Stamp duty payment – If a Transfer of property (free from any bank mortgage) into a Private Trust – I recall a mention on a SE webinar in the past that a specific Federal Legislation exists that if you can prove that the property will remain within the family unit then it can be exempt from Stamp Duty. Do you know which Federal Act this refers to? Or do we need to reference at a State level? Any assistance is greatly appreciated.

You’ll find the answer in this document if you put stamp duty into the pdf search.

Thankyou for sharing these documents Morag. Is this Q and A from Solutions Forum Webinars?
My Story that sort of relates to the question
I have received an inheritance. Have donated to an unregistered Trust set up by Solutions Empowerment back in 2013. I have set up a new unregistered Trust and will set up a bank account once I have the trust deeds. Then I will transfer the funds from one unregistered trust to another then I will be in a position to purchase a property with a small mortgage. I believe when I make the offer I purchase it in my straw name in trust of the unregistered trust which I am trustee and I believe the REal Esate agents know the process. Happy to be corrected if this is not the process.-

Yes they are Q and As and answers from threads. You should have a purchase agreement in your trust documents. This is headed with the name of the Trust so i would think you would purchase in the name of the trust as trustees for the trust.
