The first thing you might want to do is create a three step process with affidavit and complete this private process with all parties involved and create an agreement with them. If you decide to do this make sure you include a default and liability clause in your demand notices. You can only use things you have evidence for or things that are self evident in the affidavit and use the evidence eg transcripts from the encounter, as exhibits to the affidavit. The affidavit establishes the facts of the matter and the Notices asks them questions giving them three chances to answer and it will also detail what is agreed to if they fail, refuse or neglect to answer your questions and include a default and liabilty clause where there will be an amount you reach agreement on that they will owe you once the three step process is completed (and they have still failed refuse or neglected to answer your questions) Study intensively on how to complete this. The way I learnt was to complete the Non Consent for Vaccines and Non Consent for Lockdown documents (under the resource tab) and then I used these documents as a template for my own processes.

Thank you. I have conducted a 3 step process many times for traffic fines, but I will have to study this specific process thoroughly to find the answers to my questions. (Quick question tho; in which of the 3 letters should I state my demands for monetary remedies and how much $ do you think I should request?)

I’ll attach the video to this thread. The cops were from the same small town that killed a 90 year old lady holding a butter knife a few days before this encounter… so perhaps I could leverage these polices predatory reputation to my advantage

I held my position, but I was underpracticed at the time and the pirate had control of the conversation. I have practiced a lot since. There is more footage

That was excellent that you offered him a conditional acceptance and stated that you were under duress, so you can use that in your affidavit. Also he was not giving you a chance to answer when you attempted to which was dishonourable on his part. On the minus side, instead of just saying “I don’t consent” which in commerce is considered dishonourable and belligerent, you needed to say from the start what you said at the end. eg “Before we go there what is your name and shoulder number? [Ask three times and if he refuses to give it to you he is then out of uniform] Then state “Here’s a conditional acceptance and I am happy to produce my license once that has been signed by you.” There are other scripts that are better than that you can carry around in your car to help you but that is just the basic response. It is very stressful when confronted with a bully boy and it requires lots of role play and excellent scripts to be fully prepared for any encounter.

That’s very good advice about asking the policeman to identify himself 3 times before stating i don’t consent to avoid seeming beligerant. Yeah it was a good sign from God that I must practice this stuff more to become competent. Could you please send me those scripts if you have them on hand?

It is pretty much the same but some of the stuff I have is NZ specific and won’t help you eg the Police Code of Conduct for NZ and legislation from NZ (you can look up the equivalents in your legislation though). I’ll attach here what you can use. Please private message me and we’ll do it there.

As I say a lot is for NZ eg generic conditional acceptance so it needs to be adapted. for Aus.
