Back in 2019 while earning a ridiculous 75 promises an hour as a builders labourer I realised I had a problem. There was no way I would be under the $75K GST threshold and dreaded the thought of having to hand over the efforts of my labour in fines. I decided to relax on the issue and opened myself up to the idea that an opportunity would present itself in some form.

Shortly after this, and with the bankruptcy of GovCorp in March 2020, came the so-called pandemic. It was as this point that I became determined to never pay these crooks another cent.

So to make a long story short, I discovered Mark’s website, studied up on the Tax Minimisation webinar, and realised the only thing stopping me from proceeding with it was fear.

Over the next two years that fear waxed and waned, along with my previously mentioned determination, until I received a letter from the Deputy Commissioner of Taxation wondering whether I had forgotten to lodge a tax return for the past four years. After reading the letter in full I noticed something that entirely dispelled all my fears; who the letter was addressed to!

    “Dear PAUL,”

They were not talking to me!

So, I quickly wrote back apologising for the delay in lodging and offered to
have all outstanding returns lodged, including the most current, by no later
    than July 31, 2023.

I followed through with my offer lodging all five returns along with my JP’d
    Declaration.

While waiting for a reply I noticed that I experienced a few moments of fear
that quickly fell away to a growing impatience and eagerness to get the whole
    process behind me.

I received a response three weeks later.
Of the five returns, two had “zero to pay” while the other three had
large credits attached to them via a “PAYG and other entitlements” entry. Referring to the enclosed Statement of
Account, these credits had been accounted down to a closing balance of zero by
means of a series of “Integrated Client Account” transactions.

    Bottom line: Zero to pay!

If anyone has an idea of what these Integraded Client Account transaction are
about I’d be happy to hear from you.

And, if you’re a sole trader with a few years of returns yet to be lodged, what
are you waiting for? Proceed with
    confidence!

To Mark and the team, thank you.

      Indeed great news.

Just leaving my success stories here too.

Wife and I did our tax returns. My wife got hers back. 95% of her tax withheld returned. Two weeks turnaround period.

I taught two other friends to do the same. One got theirs back and received under $16,000. I suggested he not be too greedy and go for a smaller amount as he had a large sum withheld. It took him less than three weeks.

So it’s another friend and I waiting for ours. Both of us asked for a full refund. It’s been around three weeks.

I have a feeling the ATO is going to drag mine on for a while. I have been using my TFN to discharge my company taxes using the money order bills of exchange so the ATO is probably going to want to play hard ball on me. I’m prepared. The key is the money orders are in their possession and I put two deputy tax commissioners on default on it.

So yes, this is real. It does take some courage. Once you tried it once, you won’t find it so daunting. The ATO is a big bully. They sound so mean and tough until you use their rules back on them and they go silent as a mouse.

      God bless,

      Brian

Thanks for sharing your experience and congratulations.

We are about to send in the “Request for amendment of income tax return for individuals” for my wife’s 2022 PAYE tax return. They’re holding about $10k so it’s a bit different to your situation where you hadn’t paid it yet.

There is a fear element in this, I feel it in my stomach just filling out the forms! The Notary who sealed our Affidavit said something I’ll never forget, “the ATO will break you like a reed”. Nevertheless, he’s intrigued to hear how we go with this.

Hi pb. Try to relax and don’t allow fear to overcome what you know to be true.

I would suggest that the worst case scenario for you and your beloved is that you will not receive a cent of the withheld tax. They certainly will not “break you like a reed”.

I guess the best counsel I can offer for now is to get yourselves well positioned for the next EOFY by getting out of the PAYG system as soon as possible. Perhaps you’ve already done that?

Other than that, send off your paperwork with confidence and a determination fueled by what you already know; the ATO are a criminal organisation engaged in fraud. On the other hand, you have a clear conscience.

Good hunting, and let us all know how you get on.

@saul-james I was wondering if you wouldn’t mind clarifying what your JP’d declaration is please?

Is it the document in the pack with the word “Asserveration” at the top of it that then goes on to say All credits held in name <Persons Name> at the ATO are result of productivity of my labour… etc?

    Thank you.
