  • Third & Final Notice – Vax Discrimination – seeking advice

    Hi all,

Not sure if I’m in the right forum here but couldn’t find an obvious place to start this.

A job with full time hours which was confirmed and agreed to by both parties was rescinded when I informed them I had a vaccine exemption and I refused to discuss the matter any further with them. (in response to their request for my vax status and then continual requests to know what the exemption was for)

I then compiled the paper trail evidence, as well as put together an affidavit of fact detailing the discrimination.

The affidavit was sent with a Notice of Liability, a number of annexures (screen shots of texts, emails, the relevant sections of the Privacy Act and Disability Discrimination Act.) and most importantly, an invoice for the payment which I was demanding. (the full amount but with a significant discount if paid by x date)

They tried to intimidate with their first letter (outside of terms), no rebuttal of affidavit, no evidence to prove their actions were lawful.

I followed them up with the 2nd notice, the first default notice, an invoice for the full amount, but offered them the opportunity to make a settlement offer or even engage in mediation. I put that I offered these to them in another affidavit and attached that also.

They responded within the 10 days this time, however it was more of the same. Go away. you have no case, we wont be answering anymore etc etc

So now is where the IF YOU DO NOT PAY section gets much nastier than the friendly offerings of my first 2 notices

Does anyone have any experience with the disruptive actions that should be included here ? If so, what has had success for them and what do they recommend I include?

Some of the items I plan to list (and subsequently take if no offer is forthcoming):
    – Enforcement Actions (Writ of Exchange for example)
    – Debt Recovery Actions
    – Charging Order
    – Professional Indemnity Claim/Notification to insurer (I do wonder if they have told their broker about this because if they haven’t, since its now at the third notice the PI cover will be voided)
    – Winding Up Proceedings
    – Statutory Demand for Payment
    – Reporting to Regulatory Authorities

I’ve compiled these after pulling things from Mark’s Webinars, ChatGPT, some of Tom Barnett’s stuff, but I have no experience in executing any of these actions and thought it couldn’t hurt to reach out to this community for guidance.

I 100% believe I am in the right here and that I have done the process more or less correctly, but apart from helping some friends with fines and getting all my tax back, i dont have much experience getting adversaries to perform.

If anyone has anything to offer or thinks they know someone I should talk to, I’m all ears.

Anyone from SE team who can recommend any modules that would be helpful for this matter or any type of study I can engage in to better understand how to take these actions, then I’d be very grateful for that.

    Thanks,
    DB
