  • Contract or Agreement for contracting through Trust?

    Im negotiating with a business (to operate as a contractor through our trust) and the owner mentioned he will get a contract drawn up which is much simpler than the agreement I had drawn up (must’ve been too much in depth), practically my question is should I be weary of accepting a contract from the client over an agreement?

    If anyone has gone through this, is there anything that I should look out for that might be in the contract to possibly avoid? (I will receive the contract sometime next week)

      Hi Janet how you be this fine day? I am still negotiating with my client for a contracting role but it seems like the ato have added new terms on their site stating that if a contractor does regular days and hours over time that they are deemed to be classified as an employee and that the business that takes on the contractor is liable to withhold tax behind the scenes. The client is keen on taking me on but I feel and respect that he has to not put his business in the spotlight which I can relate to. Any ideas that might come to mind to assist in finding a way around it?
