Justice of the Peace How do we get them to witness signature for declarations?
Posted by yvie76 on December 8, 2022 at 4:49 pmHaving issues getting a JP to witness my signature for a Declaration for Conditional acceptance process. Can anyone provide solutions or examples of how I would go about this? The declaration format seems to be the issue…….

Have they refused? The JP in NSW I have been seeing has a instructions book, not sure if a PDF is available online but she refers to that to make sure things are affirmed or declared properly. She was actually the one that helped me correct the title format for the exhibit in vax non consent declaration.

thanks morag that was a good read. Quick Question: Is it a deal breaker if each page of an affidavit is not initialed? Unfortunately I forgot but I did get all copies certified which will help this time maybe?

It is best to get them all initialed but not a deal breaker. Make sure you do it for all future affidaivits. You don’t need to get Notices of Conditional Acceptance witnessed and affirmed just the affidavit that accompanies the first Notice.

Another thing you can do is number the pages of your affidavit so that all pages will be taken into account eg page one (1) of six (6) etc

Yes, correct the JP I spoke to would not except the format of the Declaration in the form of an affidavit. I have the JP Handbook for Queensland. But it does not provide examples. The other option is a Public Notary.

2 JPs have knocked back the declaration in the form of an affidavit. We keep getting told the format is incorrect and to correct it. I’m quite disappointed Module 36 Conditional Acceptance process doesn’t include tips or ways to solve this roadblock to complete the first step. A lot of time and resources is wasted in travelling from town to town to get the signature witnessed. The webinars don’t mention the issue so you are left to sort it out which is challenging at best.
I need a structured process that provides all the necessary steps including the issues that may arise with a webinar to match each step.

There are no magic bullets it’s all about learning how to deal with these types of people and taking charge right from the start of every meeting. You need to dress well, prepare your scripts with them and hold them to account when they are not doing their job properly. Arm your self with their rules and regulations, don’t show them the content of your documents as that has nothing to do with them, it is your private and confidential document read the above resource I shared with you again. We all have these challenges when we start out but it is up to us to learn how to navigate them.

Thanks for the tips but unfortunately they are pretty anal with their rules here on the Gold Coast whether in a shopping centre or seperate office. I applied your process and was given the impression they would be committing fraud if they didn’t see the documents and provide advise on how to correct the documents for them to witness the signature. I have read the Qld JP handbook and they must follow the protocol they have been given. I have found no loopholes to get around this yet. Yes it is part of the learning process. But I feel in order to complete a process you need to be aware of the pros and cons and this hasn’t been clarified which can prolong completing a process and cause confusion.

You can put in a complaint for them refusing to witness your documents. Make sure you get their names if you deal with them again. Here’s another alternative
