My personal tax return
Hi everyone,
Some of you might be following my progress with using Mark’s method to minimise my personal tax expenses. Here’s an update.
To place some context, I have used my personal fictitious entity (name in BLOCK LETTERS) to draw funds to pay for a company’s tax liability that I am a joint director with my wife. I used the Acceptance for Value and the Money Order method on three occasions. I received no response from the ATO protesting this payment although they have sent me overdue notices on my company taxes, which by the BOE Act 1959 Sections 47 and 48, means they have discharged me of the liabilities.
I have also put the Deputy Tax Commissioners on default for the company tax liabilities after doing the correct procedure of the 3-step estoppel method. The only correspondence I received from them is their reply to me stating that I reserve the right to use the Mollicker v Chapman case precedent to contest their legitimacy. You can see that in a recent post in this same discussion forum.
So around 5 weeks ago I sent my personal tax return form to claim the full amount of my tax withheld as a refund. It was in the same mail as my wife who got her refund back in just over two weeks.
I have friends that used the method I suggested and they got their refunds back in 3-4 weeks time.
Any one else experienced this before where the ATO might be holding back on your tax returns because you have done other things that the ATO doesn’t like but is legal? What types of things have you encountered with them on these occasions?
Would love to hear your experience.
God bless,
Brian
