  • Notice of Penalty

Hello, I have been using Marks methodology on minimizing tax in the US and I’m Looking for some direction regarding a notice of penalty from the IRS. Back in May, I received a letter stating that I had filed a purported tax return that claimed one or more frivolous positions and that I needed to correct my tax return. In response, I made what I thought were the necessary corrections and resent the tax form along with a letter explaining the updates along with my notarized declaration.

Now in December I’ve received a notice dated 12/2/24 (which I received on 12/7/24) assessing a $5,000 penalty. The notice states that I must pay the penalty by 12/23/24 and indicates that even if I wish to contest the penalty, I am required to pay the $5,000 upfront and then file a claim afterward to request a refund if my challenge is approved.

I’m seeking guidance on how to handle this situation. How can I effectively contest this penalty and hold my position without immediately paying the $5,000? Any insight or direction would be greatly appreciated. Also I’ve taken the minimizing tax module however if there are any further recommendations for other modules that might address this on the website that might help me I am open to suggestions.

Has anyone else experienced a similar situation with the ATO?

For reference I’m attaching a copy of the letter.

Thank you for your time and consideration.

Hi there is a Q and A this Wednesday and you could ask your question there. Just get there on time and ask your question in the chat and put a Q… before the question so that Mark can see it easily… https://solutionsempowerment.org/event/general-qa-december-11/

<div>I would say that, when you replied to their assertion that you made a frivolous claim, you have now accepted that all the communication to you was valid.</div><div>I would write a new letter saying that you have made a mistake and apologize for your mistake. Then say that you do not consent to the $5000 penalty and not consent to being a person. Then say that you do not consent to the $5000 penalty and you not consent to being a person, and that you do not Consent being under the authority of the IRS .</div><div>You need to send an affidavit containing all those points, including the statement that you are a man, and man is defined in the authorized version of King James Bible, Genesis 1:26. </div>

Wednesday night webinar is the forum to have Mark answer your questions.

You can also watch the webinars under the Knowledge Tab “webinars & modules”

Mark has other modules in replying to Letters from IRS (ATO in Australia) etc.

There are several modules that you can watch the webinar (included in membership) then if you want the support documents you can purchase those.

Here are a few webinars to watch to gain clarity on the situation.

Module 4 – Accept a Public Offer To Contract (eg Statement of Account) On Your Terms

Module 4b – How to Accept an Offer to Form a Contract in Your Favor – Part 2

Module 9 – How To Hold Your Position

Module 3 – 10 Ways To Discharge Debt

Perhaps you can go through the module list and see what headings would be applicable to your situation.
