    Hi fellow members,

    I listened in to a webinar recently and the man hosting it said that in the case of private/unregistered trusts in Australia, should you wish to move your property under that structure the land titles department will not change the holding to the trust name but retain it under your name as the beneficiary, therefore not offering you the protection from the pirates & parasites.

    Can anyone confirm if true or incorrect?

    The protection you have is that it is in a trust and therefore they need the consent of all parties to enable them to extract anything from the trust. Here’s some q and as around trusts that show you how to defend your position in court (if necessary)

    All contracts of sale documents will be named and signed as: “Trustee Name as Trustee for Trust Name”

    Land Title will just show: “Trustee Name”
