    I sent a Notice of Objection was sent Via registered post to QLD Police (to object to an Infringement Notice).

    QLD Police have sent me a letter of response that states the following;

    “TRAFFIC INFRINGEMENT NOTICE NUMBER: XXXXXX

    ISSUED ON: 26/3/2023

    I acknowledge receipt of your correspondence concerning the issue of the above infringement notice and I also acknowledge that the matter i also already being dealt with by (SPER).

    I advise that all investigations have now been completed with respect to this matter. I am of the opinion that this notice was justified in the circumstances and the infringement notice will not be withdrawn in this instance.

    As the matter is currently with SPER, I encourage you to contact them directly to discuss your options.”

    HOW SHOULD I HANDLE THIS MATTER NOW WITH REGARDS TO SPER?

    my suggestion is send sper the 3 notices or at least the first one but get it notarized as they

    will not respond other wise try and send it to the ceo if not look up the ABN number as this

    tells you who owns, or is in charge of this company so send them the notice they are also registered under Dunn and Bradshaw

    as which then they come under the Clear Field doctrine which means they have given up

    there sovereignty so there no different to Mc Donald’s.

    i mean get a Notary to stamp your Notices or even post it for you costs a little

    extra you have 2 types of Notary’s first is a public Notary which is of the land the one you want

    but any will do and a notary public which is of the sea and the sky example i called a local lawyer

    and asked him if he was a p notary or a notary p he said there both the same i told him that

    they were not, and explained to him the difference goes to show did not do hes research

    just a thought.

        My ideas with the system forcing us to contract with them.

        The way I see it now a days is that the only way the corporation that has forced you to contact with them will cancel the (infringement) or any contract for that matter, is to put pressure on them by supplying a fee schedule, getting them in a default judgment (3x notices process) and then send them demand for payment notices with a supporting invoice.

        Then once they don’t pay you them have to summons them.

        I could be wrong but it seems they don’t give a shit about the Law, 1 because they know the courts are on their side, 2 that we won’t follow through with the whole process.

        So my opposing idea is to instead just fight it in court, requesting to have the infringement heard in court. They then send you a summons (offer to go to court) and you conditionally accept it.

        They can not provide evidence to the conditional acceptance so it’s all done.

        The contract (infringement) is only processed once you pay it, your license points do not come off until you have paid or set up a payment plan.

        So once you request to have it heart in the courts the corporation that issued you the infringement then discards it.

        Or it’s sent to the courts either way they don’t bother you anymore because the courts are now taking on the liability.

        Here is a conditional acceptance form I have done.

        I’m in the same position as you now with a infringement but the only difference is I noticed the ones who sent it with a conditional acceptance notice/ demand notice with concerns that needed to be met, one being how could I breach the contract if I have signed the license All Rights Reserved.

        If they ignore that my plan is to have the request to the matter heard in court and conditional accept the courts offer.

        You can ask to have a sper matter or most infringements heard in court just so you know.

      Thank you for the detailed reply bro.
      The response was sent about a week after receiving the infringement. How does this time-waited factor into the situation?

      Also, do you have a letter template you’d recommend for conditionally accepting these pirates’ offer or summonsing court?

        It matters only if want to pursue them because it legally has to be rebutted within 72hours.

        I have posted on here recently a document that i used to conditional accept a summons.

        It should not be that hard to find.

        I just see it now that we ask to take it to court straight away or you do the 3 step process and follow it up with legal action.

        We I get some time I’ll send you some documents I have been sending as demand notices.

        Yo be honest it’s pretty basic, you are just ask questions to prove they have authority over you.

        I’m sure there are documents on here but I’m happy to send some through mate.

          Yes there are documents in the modules that one can use as templates (worth every penny that one pays for them as long as whoever purchases them studies webinars alongside them so that one has full understanding of the process and the wording etc) and if you have completed and understood the non consent and claim of right documents that also is a blueprint for how we need to write Notices to deal with these offers.

      Yes it is included in the process. it is within the affidavit accompanying the first of the three non consent notices.
