  • Trust Deeds and lenders

Posted by chris74 on February 15, 2023 at 9:49 pm

Im using a non bank lender to apply for a loan on a property. They seem quite ok with it going in the trust name but they said they will be asking for a copy of the entire deeds of the trust. Im obviously trying to avoid that because its private . Should i make it available to them , im not sure there is a way around it or what implications there would be if they had them .I will go back thru Marks videos and info i have . Any info/advice would be greatly appreciated.

When applying for an account we allow the bank to view the Trust Deed. It doesn’t put the Trust in danger or transmit it to the public arena, we are simply allowing them to peruse it to show them it complies with trust law and is correctly written. I would think a request to view the Trust Deed before extending credit is normal procedure.
