Unopened Fines do not consent
Posted by denia on September 6, 2024 at 9:58 amWell this is new.
I’ve had fines sent to me I send them back unopened Do not consent to contract.
I’ve done this to about 5 envelopes over a period of a year approx.
Today I’ve received a text message from SA FINES.
I haven’t opened the text message but can see the first few lines on my phone…
‘YOU HAVE A NEW FINE THAT IS NOT PART OF YOUR CURRENT PAYMENT ARRANGEMENT TO ADD THIS FINE TO YOUR’
that is all I can see without going into the text message. I do have a payment plan with them. I pay $10 month.
Any thoughts on what I should do. I’m guessing if I ignore it they will debit my bank account.
As mentioned I have not consented to contract, have not opened any envelopes sent to me. Have no idea the amount.
Thankyou.

Suggestion; you could contact them and ask them to take your email off their database and ask them to stop sending you unsolicited correspondence and if they send any more it will be deemed harassment. Any more unsolicited emails and harassment will incur a fee of $800?
-
That is so good, I will let you know how I go with it.
I don’t want to give them any ammunition so I’ll just stick to what you’ve suggested and say nothing else.
They sent me a text message, funny it is addressed to my Christian name only, no surname.
Q. Is it OK to open text message & read it completely.
Q. Should I contact them by email or phone.
-
You can also ask them to take your phone number off their database the same as the above suggestion. I did both email and phone in this way with the adversary and they stopped communicating with me via these mediums.

Fines SA will 100% garnish the bank account, I have first hand knowledge of this
-
Thankyou for your replies, I have transferred all my funds to a joint account. Not sure they can touch that.
-
You can do a deed of revocation of power of attorney with the bank as well if you want to.
-
They will only go for the bank account in the same name as the fine i believe
-
Excellent. I can’t believe they sent a text message about it.
I received a fine about a year ago and two more envelopes after that. I wrote Do not consent to contract on all three. Then it stopped until about three weeks ago I received another. I’m just guessing it’s a new fine but not 100% sure. I received only two envelopes this time before the text message.
The text message in addressed in ALL CAPS ofcourse but only my Christian name. I’m not sure if I should open the text message. I’ve only viewed the first few lines that pop up. I’m worried if I open it they will be able to tell then it would be an admission that I’ve received it thereby consenting.
Your thoughts

unless both phones are iPhone and you have read receipts turned on they shouldn’t see you read it
-
wouldnt a text message be hearsay information? Maybe ask whos making the claim for the fine? and ask when can you meet the claimant so you can settle the matter honourably and when they ask if its you just be like “Ive been known to use the name/person”
-
Thanks. You know this whole thing is so frustrating but fun and rewarding at the same time. Learning each day.
If I didn’t open any of their envelopes do you think the fine will be original amount or have had fees added on.
I’d be curious to find out, but not sure how or if I should bother.
-
if they make any claims it’s all about holding your position and requiring them to prove their claims with evidence. When I was continually being harassed with offers of fines, I decided to do a three step notice with affidavit and that has seemed to do the trick. We now have an agreement that they owe me money memorialised by a fourth step affidavit and settlement notice, because they haven’t provided answers to any of my questions.
-
There will never be a claimant to testify with first hand knowledge, stay on point and dont stop asking to meet the claimant so that you can settle the matter honourably, thats how i see it now, have fun with it nothing to fear lol

Well I received an email back from SA FINES.
Once again I haven opened it only read first line in notifications.
It reads
‘OFFICIAL Hi, thanks for reaching out to us’
Q. Does it matter if I open it.
-
Well I opened it. They are unable to identify my account. They need my email, address, dob, d/license etc before they can assist with my enquiry.
Ironic I’m asking them to cease using my email, phone number etc. And they send another email.
That’s governments for you.
-
Yes it’s ridiculous. Thank them for accepting your offer and let them know you will be sending them an invoice for your time.
