    Hi all,

    I am trying to claim an exemption of transfer duty because I am transferring properties from me and my wife’s name into a family trust which we are trustees.

    can you anyone point me towards the ACT here in WA which is the equivalent to the Queensland <b style=”font-family: inherit; font-size: inherit; color: var(–bb-body-text-color);”>DUTIES ACT 2001 – SECT 118 .

    I have been on the phone to revenue, and they are claiming that there is no exemption.

    Any help will be appreciated.

    Look for similar sounding Acts and feed in the same wording it has in Qld into the search bar and if it is there you should be able to find it. That’s how I find equivalent NZ acts and wording to the Acts Mark quotes.

    Hi Sean

    Despite every State and Territory having their own Duties Act, they are all unique to each state. The reason for an exemption of Stamp Duty varies between States. You need to read through the WA Duties Act to locate what exceptions and the reason for it is. The other alternative is that it is legitimate to “gift” your property to a Trust and therefore bypass stamp duty
