I would to ask if anyone knows where in the legislation does it state that if someone refuses to take a payment that the liability is now discharged to pay that debt.

Here is something from NZ and other information that might help, in the BOE PDF it quotes the section of the BOE Act that is relevant. Read carefully through all of these and you will find lots of helpful information.

Thank you Morag-Janet, I have looked through all that info. I have asked the bank to send me a statement of account with all payment options that are meet the Banking act 1959 as on the statement of account statement of account there is no tear away section.
They are refusing to provide me this still so the game goes on, I may now just turn it into a contract with a BOE and go down that path with it all. Thank you again.
