Hi all, I tendered payment for a liability in December of 2020 by way of “economic impact payment voucher” or BOE. After After about 18 letters between the “Lender” and various debt collectors/agents etc I finally received a claim of debt from the plaintiffs lawyer. I am unsure if this is another tactic they use in order to get you not to hold your position. I have never set foot in a court room and hope I don’t have to however I need to respond to this claim. There are forms used in this process which Mark suggested in Defending a claim. For the most part I understand that you must file

    1. Notice of intention to defend (form 6) with a <font color=”rgba(0, 0, 0, 0)” face=”inherit”>Notice of </font>Defence<font color=”rgba(0, 0, 0, 0)” face=”inherit”> (form 17) and the Notice of </font>Defence<font color=”rgba(0, 0, 0, 0)” face=”inherit”> must be </font>accompanied<font color=”rgba(0, 0, 0, 0)” face=”inherit”> by an </font>Affidavit. All to be filed in 28 days after being served a claim

<font color=”rgba(0, 0, 0, 0)” face=”inherit”>However, I am confused as to whether I just need to file form 6 and form 17 and the affidavit OR if I need to also file the Notice of D</font>efence<font color=”rgba(0, 0, 0, 0)” face=”inherit”> and Counterclaim which is (form 18)?</font>

    <font color=”rgba(0, 0, 0, 0)” face=”inherit”>Any suggestions would be appreciated.</font>
