I went to a JP last week and she said I had to sign my name and date every page of my Affidavit now, instead of Initials. Is this true? It is an Affidavit to go with my Tax returns. It felt like she was getting to be the name. I had a line error in it, so I wrote another one one out and just went somewhere else. This JP questioned my reason for wanting to do the Affidavit and when I said I’m doing it to establish the fact that I am a Man first before any name, a right giving to me by Our Creator. He said this is not an affidavit and wont sign it. Has this happen to anyone else? I am going to see another one now.

I think I would tend to not go into any details or conversation about anything content wise with a JP it’s not their business (same as when I get a post office to sign a ‘certificate of mailing’ doc if they ask what it is I’m very light and say to them oh you don’t need to discuss (or worry about) that you are just witnessing whats gone envelope and move on warmly and they have always been ok with it. The thing for me is not getting into things we dont need to get into. I might after signing was done if they were genuinely interested/ curious

Hi, JPs don’t need to know what your affidavit is about, they are there to witness your signature. When, or if, I think JPs will have a problem with any of my documents then I cover it with paper and paperclip the paper to each page and just leave a space on each page for signatures. I tell the JP it is a private and confidential document and that I just want them to witness my signature. It is good to date and sign each page as long as the JP signs it on every page as well. You can put Deponent: [your signature] Taken By: [Jps signature] at the bottom of each page. The only time the JP has to see your document is if they are signing it as a true and correct copy and even then they are meant to be impartial officers just witnessing that copy, they also only need to look at the first and final paragraph of each page to ensure it is a true copy, they have no right to cast judgement on what you are doing.

The second JP was the same. He was questioning me about the use of an Affidavit and trying to get me to do a Stat Dec. I said to him I am not operating in the Public realm and it doesn’t matter if he doesn’t believe what I am stating to be true or not. He didn’t want to sign it and started saying that its not right. I thanked him for his time and left. I will have to go back to the original lady, at least she was good enough to sign the one with a mistake.

Thank you both for your advice. Im feeling a bit depleted at the moment and I’m kind of done with people questioning my belief and understanding of this corrupt system. It is hard to un-see when you see it from multiple sources.

I had the same experience today and last week, I still initialled each page and they also wanted me to sign in black by using the pen they used, I politely said no thanks I will sign in blue.
Just go to different JP’s until you find one and they become familiar with you, no point in wasting time and energy on them.

As Morag pointed out, they are only there to witness the signature and verify your face to the ID and get you to read out the Affirmation.

Also a good idea to take in a printout of the Justice of The Peace Association (whichever state you are in) website where it states the roles of the JP and remind them of this.

      Thanks for that, Azza,

I was a little taken back from the first one. I think he is really stuck in his world and it’s his world and no one else’s, the second was polite, but couldn’t understand why. I might have to remind them what their job is and be happy that someone with a different belief has come in to use your services. Just a bit of a time waster, thats all. I find most JP’s quiet stand offish, or it’s like you are interrupting their day.

      cheers Ant

I find the less you tell them and the more calm confident and in charge you seem to be, the more relaxed they are. I always dress well as people tend to treat you with more respect when you are well dressed. I tell them what I need them to do and as Azza said “they are only there to witness the signature and verify your face to the ID and get you to read out the Affirmation.”

I was in my work clothes, maybe that was it. I thought good manners and politeness would be a key to someone’s character, not the clothes. I have taught my boys the importance of manners and how it shows not only respect, but a true judge of character. I get how one must dress well when going into court, but I didn’t think it would matter at the local library. I might have to put the suit on next time and see if there is a difference in behaviour….lol.

          Thank you Morag.

JP’s can be a strange breed thats for sure. I suppose something about the demographic is quite specific – the type of individual attracted to applying. It also depends upon the context. Are they in a booth at the shopping centre with not much to do but read a novel, or are they in a one hour slot at a community centre with 25 people waiting to see them. I’ve had the spectrum of experiences from highly pleasant, to good to indifferent, to evil and inbetween. After years of practice I have developed a instinct for quickly observing the manner of who I am dealing with, how to approach them, what to say, definitely what not to say – and also, when to simply walk away and not waste my energy because they are being too contrary and not worth getting stressed about. I’ve had to report JP’s for misconduct before, which I did just on principle. I saw a news article recently explaining a a recruitment drive for JP’s because of low numbers. I momentarily wondered if it was something I would be interested in. After the explanatory steps, it was mentioned ‘ your social media accounts will be reviewed to assess your ethical hygiene’ or whatever. Okay they didn’t say ethical hygiene but almost! I’m not on social media but that was enough for me! In Australia, because of the imaginary virus no one can demonstrate exists [cough] the law has changed to allow a wide range of professionals to act as a JP. This feedback can be found on the Attorney General website. This is SO much easier as you have a better range of personality types from amongst the community and no one thinking they have more legal knowledge than you do. ( A client told me a JP actually crossed out words on her Affidavit saying they had no legal relevance! I was ready to punch the wall I was furious! ) The caveat is that, these professional types are not obligated and have a right to refuse. And, don’t mention the words ‘JP’ they will only get confused. Simply ask for your signature to be witnessed. A bank teller with 5+ years experience is one example, that is probably the easiest. As is the postmaster or manager of a post office, or a post office clerk with 5+ years on the job. I remember they are paid to be there, it is their job to serve, so while of course I am always respectful and pleasant , I remember to be confident and not feel like I am imposing on their time. Any professional that is a member of a professional organisation ( accountant, psychologist , doctor, chiropractor for example) are also able to do this. But I avoid small businesses because their time is too precious in my perception, compared to an employee of a corporation.

Thanks Anson for your feedback. I was thinking about their job as well. It seems pretty laid back, but I think I would get over it quickly. It would be a good place to do your own research between people. I like being active though, but if I was going to do it, I would make sure I’m that happy helpful one in the equation. The people normally visiting them, are the ones that need a kind word or even a positive experience. The courthouse JP’s would see a lot and that would be the one place you should not be judgemental. The World needs people to be on the helpful side right now and not out for themselves. With so much deceit and corruption going on, especially the past 2-3 years, it would great to see more in all fields. This SYSTM is BRKN.

              Take care and keep smiling.
