  • UNREGISTERED TRUST QUESTIONS

Posted by tashi on November 28, 2022 at 6:36 pm

Hey:) I’m very passionate about not feeding the system with my blood sweat and tears and I believe this is the way out for humanity to be free is to be private. Thanks for the support, in advance. I have read through all the messages here, read the attached PDF’S & watched the video a few times and still have some questions.

I am settling on a house on 20th December 2022, will the creation of the trust be done by then? And all I need to do is have the trust is making a bank account?

I plan to have a trust for my home and my business.

I have some questions please, thank you.

1-stamp duty- what happens when I go to pay stamp duty for my trust’s estate ( house) what if they say the trust must be registered?

2-Is it common to be looked into trust? What triggers pirates to want to look into a trust?

3- I am eliminating my credit card debt ( only $8k so hopefully nothing to trigger) I also have Centrelink debt but no one is asking at the moment about that it seems ( still only $5k- so I don’t think I’m a big trigger)oh and just recently a policy woman charged me 2000$ for unregistered vehicle, uninsured ( I was 4 days late and didn’t even know it was unregistered!)

so, is it a bad time to make the trust due to these debts?

4- is it safer to have a house in trust and a business – sole trader- in a separate foundation or is it ok to have it all in one trust? I’m not a big player, I have a small business but I plan to grow it.

5- advertising my sole trader business on YouTube, Facebook, google, pamphlets, school newsletters is all in the public. If someone purchases I either give them a private invoice or a tax invoice with the ABN of my sole trader name? So, half the invoices I do tax with or can all go into the trust with no tax obligations.

7- can I have business insurance? Can I have house insurance? Is the owner on these docs my person or my trust?

8- bank account- I learnt here that I need to open a Westpac community business solutions account- show the bank this page if they say I need a TFN I follow this page and show them?

    https://www.ato.gov.au/Non-profit/Your-organisation/Does-my-not-for-profit-need-to-pay-income-tax-/Types-of-income-tax-exempt-organisations/Community-service-organisations/

I say to the bank, I don’t need a TFN or ABN because I am a non- for-profit? I don’t understand this because I do give invoices out.

9- Can I have savings in this trust account and spend from it?

10 – once I have put the house in the trust, what ongoing things do I need to do? What education do I need to keep it safe? For example, if there is a 4 yr window to garnish the estate, how do I hold my ground… I would really need to know how to do this, do you provide information AND support?

11- do I register my business name with ASICS?

12- how many people to start the trust ( the settler( a friend?) , trustee ( me) the principle ( me?) primary beneficiary ( me?) secondary beneficiary ( my son? ) so, will myself, my son and our dog be enough?

Thanks, I am learning and having support that I know I’m not going to stuff this up as its my first home. I am willing to keep learning but do need support along the way to not accidently incriminate myself! i need to know how to hold position if need be. thank you!

    Hi Tashi,

Great questions. I’m interested in seeing the responses to these questions also.

Hey tashi, I’m curious if you had much luck getting any info and if you’ve started operating out of the trust? Mark is very switched on and there’s a few people here to that know the ways but it’s hard to get answers I feel, I have a private trust too and are using it but do get nervous that if I needed help later defending myself and my decisions to operate in the private It wouldn’t be around 🙁
