  • DVLA road tax reclaim, hearing 15,3,23

Hearing 15th March: in a matter involving the DVLA (UK), i did a direct debit reclaim for road tax. the DVLA claimed that i owed them, i ignored their notice(s) and the have issued a Single Justice Procedure at a court miles from me. i asked for a local venue and time to prepare a defence.
They gave me 3 weeks and have not changed the venue.
After watching one webinars Mark talks about Notice Of Non Consent To Proceedings,

i have sent this the court via email:

Notice Of Non Consent To Proceedings

In the matter: Secretary of State for Transport / DVLA v Mr Burgin / XXX XXXX XXXXX scheduled on 15th March 2023 at the Redditch Magistrates’ Court (hereafter “the court”)

I am before the court under duress, protest and threat of menace

I do not consent to the SJP it violates my inherent right to trial by jury, it is therefore unlawful

I do not consent to conducting business with Driver & Vehicle Licensing Agency (DVLA) the executive agency of the Department for Transport or any of its employees or agents

I no not consent to the court proceeding nor accept its offer to proceeded

I do not consent to being surety for Mr Burgin / XXX XXXX XXXXX

I do not consent to being surety for the proceeding

The charge/s before the court was attained without my consent and I am under no specific performance as no full disclosed signed contract has been presented

I require the bonds be immediately brought forward to me so I can see who will indemnify me if I am damaged

[on the right] By: Xxxx Xxxx Xxxxx

    All rights and dominions

    reserved, none waived ever

    DATE

i also sent the presentment back to them:

    [WRITTEN DIAGONALLY ACROSS THE PAGE:]

    Received: DATE

Unclaimed, Do Not Consent To Conducting Business, Do Not Accept Offer To Contract, Return To Sender For Cause Without Dishonour

i have also sent DSARs to the DVLA, DfT & court. and a Notice to all parties claiming; to evidence consent, adduce case bundle etc…nothing has been received.
Notice attached, i think i should file it on the court record?

Qs. 1. has anyone had any success like this?

    2. should i contact the court to see if they are running the trial? or do i declare it has nothing to do with me?

this is “criminal” matter somehow! so likely there will be a warrant if i do not attend?
