The year is now rolling on full steam. Attached is our invitation to be on the next Wednesday night webinar. Is a 1st for the Wednesday night series, “filing application for orders for a Default Judgment” and has been requested now for many months, ever since the non consent process was created.
Naturally, we’ll share actual documents used to file for default judgment. We’ll share how to disposition your adversary that will enable you optimum opportunity to file an application.
We’ll walk you through both, a traditional court process, and that of filing with a common law court process.

Do I simply go to court with particulars, had to clerk and say “i want default judgment ex-parte”
Since the 22,12,22 I have heard no more from them.
Notices of claim have been sent/served along with DSAR (totally ignored)
I am wondering if I need to file a claim or can I go for default judgment off of what I have done so far?
How best to obtain remedy? I have watched and got this module but unsure of the actual “legal” process.
Here is a breakdown of events:
19,7,22 I had an motor (vandalism; 4 tyres and exhaust box) insurance claim (logged with Ray) last July, Aviva Insurance Limited (I believe) via Quote Me Happy (QMH).
After hearing nothing for some weeks I contacted them and put a complaint [2,8] in. Finally they collected the car [9,8] and a month later [23,8] claimed a total loss! I disputed their offer [24,8] sent examples and informed them there were valuables in the car (I honestly thought the matter would turn around in 3-4 weeks).
I have list of particulars chronological that I can send, this is most of it and the key (I think) moments ( out-going communication):
31,8 QMH This is not accepted, where do you get that I have accepted? Also sent to Ray (Aviva), email
31,8 Complaint: Time limit for response + DSAR, email
8,9 < from Stephen CoPart (they were in possession of car), told him not to touch car, having back, he’d heard nothing from Aviva, telephone
23,9 < Copart, when are you collecting belongings. Told him send email and I’ll copy Aviva in, telephone (recorded)
23,9 copied Avia in reply, email
Please find attached our claim in relation to this matter. It is full and final and non negotiable.
10,10 > Notice of Claim (second) email
20,10 3rd and final Notice of Claim and 7 day Notice to comply with DSAR sent 2,9.
3,11 email; this Notice of Default and Letter Before Claim. email: 1. an update to our complaint on the handling of our claim. 2. to know when we can expect; a, our property being
returned to us. b, a final offer of settlement. We wish to remind you that our DSAR has in no way been acknowledged.
1,12 Notice Affidavit and Statement of Fact
6,12 spoke to Kyle “we will deliver Friday” recorded
15,12 email notification property missing & Opportunity to Cure before Statement of Claim inc missing/damaged property.
19,12 > invoices for items replaced.
20,12 Amy & Prerna, I stated most items in cardboard box and also a fishing reel stolen; Opportunity to Cure before Statement of Claim.
22,12 Replied stating our position and reference to conversations.
23,12 > acknowledgment of interim payment and maxims of law.
30,12 > sent evidence of our loss of earnings and requested details of the fishing reel that was stolen.
6,1,23 > asking Amy if received previous two emails as heard nothing.
17,1 > asking Amy why ignoring evidence of our loss of earnings and the fishing reel detail.
25,1 > Statement of Claim pre litigation.
