  • ‘Settler’ Trustee

    Hello all,

    Me any my wife own properties in our names which have mortgages on them. I want to put them into a Private Family Trust and want have full control of the assets.

    Can I be a ‘Settler’ a ‘Trustee’ and a ‘Beneficiary’? if not how do I structure it? My only kids are 9 and 11 so not old enough to be a Trustee.

    I don’t have and family living in Australia. I have a very good relationship with my Mum and Brother if I needed them in the trust,but are not in the country.

    I would rather to leave my wife and I names on the property Title

    So how do I go about it?

    Could my Strawman be the Settler and my living name be the Beneficiary?

    Or could my Mother or brother be the Settler and deed our properties into the trust.

    It’s really best to purchase a private trust through Mark as he has had many years of experience dealing with the system and using his trust instruments and he makes sure these trusts are water tight. You will also have his support when you need questions answered in relation to the trust as well as having a 1 hour private zoom meeting with him as the trust is being set up. He is the settlor (he has nothing to do with the trust once it is set up for you) and you and your wife can be primary beneficiaries with your offspring as secondary beneficiaries. You will have total control over the Trust and one of you can also be the principal who is the ultimate decision maker.
