  • How to get SECOND ADJOURNMENT?

    I am scheduled for court tomorrow, but I cannot attend. (8 hour drive from where I am and I can’t get there). but 3 notices have been sent

    I already requested one adjournment for one month and was granted it. (I just think if I email the court again saying I need more time the magistrate might make a ruling in my absence)

    How do I get second adjournment? Should I email the court, or maybe go on zoom and request the adjournment that way?

    Q.. If there are any mistakes on the documents the adversary sends to me?

    A… You can get it dismissed or at least adjourned so it can be corrected especially if

    they can make lots of money from the proceedings.

    You’ve got to have valid reason for an adjournment

    eg documents weren’t filed, I am sick today or you can faint. And then they’ll have to

    adjourn and it’s good to notice the other party before the hearing if you are

    intending to adjourn. It’s never ever too late to adjourn, only after a judgement, if a

    judgement hasn’t been reached then you can adjourn at any stage.

      Should an email suffice requesting the second adjournment? (cause I can’t actually get to the court, it’s interstate)

        It’s probably best to ring the court and ask them if email is ok. Just remember to record your phone call and any emails and replies you get.
