Question Answered During This Q&A Webinar
00:02:44 Catherine: Q- with the bills of exchange process what is an amount of time to wait for the other party at the venue you gave.
00:02:48 Terence Douglas: Q I Didn’t get the names of the arresting officers at the time. I have rung the station where they work and they refused to give me the names. I went into the station and asked and they refused to give me the names and the station superintendents name. I have noticed the SA commissioner of Police with Particulars and Default notice to date, since he is the informant and he hasn’t been forthcoming. Any ideas? What compels the Commissioner of Police to cough up? Go into the station and demand the arrest report? Since I haven’t been able to get the arrest videos and names etc is this strong enough to get an adjournment since I haven’t been able to settle on the way to court?
00:03:06 Brandon: Q. The ATO has automatically enrolled me for quarterly PAYG tax instalments based on last years income (they give you 28 days after the quarter ends to pay the instalment). I plan to do my tax return as per the ‘Minimising Tax’ module next year but I’m not sure how I can avoid these quarterly instalments until I get to the end of the financial year. Any idea’s on how to get around this one?
00:05:13 Catherine: Q- do you know of anyone who has set up a bank account in the last 6 months for the private foundation? we are on our on our 4th bank
00:05:16 Brandon: Q. How do you respond to a magistrate that tells you the evidence in your affidavit means nothing and keeps cutting you off, aggressively interrupting you and not letting you get a word in?
00:09:31 Brandon: Q. You often talk about how the banks securitise Promissory notes, BoE, Money orders. Can you explain what that actually means and how that works? And how does a bank make any money from a BoE that is worth only $1?
00:09:54 :Samuel: L: Q. Have you heard that they are talking about removing cheques. So if they did do this do we have an alternative ? Can we attach a promissory note to a bill of exchange to constitute a simple contract should they be successful in removing cheques
00:14:56 :Samuel: L: Q. Can I use a form such as the notice to admit facts in relation to a criminal matter like a speeding fine?
00:19:29 Terence Douglas: Q What is the Interlocutory process for a criminal traffic situation? Injunction? What set of rules do I use to get things turned around and get out of the defendant position and force the prosecutors hand before court?
00:22:42 Brandon: Q. In regards to the ATO PAYG Instalments, I think there may be an option to amend the instalment notice and put in manually how much tax you expect to pay that year, and then pay a quarterly instalment based on what you put in. Would it be wise to just do it that way or should I call them/write to them and negotiate that way? Turnover is over 75k so I have to do BAS statements at this point.
00:23:55 maxine: I visited three different RMS’s (Service NSW centres) attempting to lodge an AllRightsReserved signature, and with every attempt have been rejected on the basis of being shown their policy document which claims that they can reject a signature which contain certain symbols and characters that may have a legal meaning. I think they may have increased training on how to refuse AllRightsReserved signatures. How can we circumvent this?
00:43:11 Terence Douglas: Q When you send an A4V money order, do you send the original or a copy?
00:44:05 Catherine: Q – for the BoE if you can’t get 5cent stamps for the stamp duty, can you use 10cent stamps?
00:46:15 :Samuel: L: Q. Is the citizenship certificate a substitute for the birth certificate? And can one bond their citizenship certificate
00:55:29 Claude: Q How would you respond to State Revenue Office (SRO) in this situation.
Your property is held under a company name ‘ABC Pty Ltd’ and the mortgage has been discharged. SRO have failed to answer my companies 3 notices asking them to provide proof the company has an agreement with SRO to pay landtax since the mortage has been discharged. SRO are still claiming the company owes land tax.
SRO main arguments are –
1. The Land Tax Act 2005 (Vic) has been validly enacted and received royal assent 29 Nov 2005
2. The payment of land tax DOES NOT require a binding contract between Commissioner and taxpayer
01:03:25 John Melbourne: For those of us who are not experienced in a court situation, does Solutions Empowerment have court documents to use in a roleplay scenario?
01:09:43 Derek: Can the person in the Uk who asked the question let us know which bank they are using for the Trust please?
01:25:17 Aaron Sandford: Question.
A fine has lapsed and I have defaulted and is now being enforced by Services Australia.
I would like to follow the procedures outlined in the fines webinar. I would like to send an email, apologise for default and then show my interstate licence etc… however now that it isn’t with the police anymore, who do I send the email to?
01:27:06 maxine: Can I get a Queensland license using a n.s.w. address?
01:27:47 Claude: Aaron – try to send an ‘application for extension of infringement’ through the magistrates court and that can give you a 28 day extension and bring the fine back to its original format i.e.Notice
