    Hi! I’m wanting to transfer a NSW property title from being in my personal name (it was purchased many years ago) into our private family trust. The NSW Land Titles Office says that it has to be done electronically now, using a conveyancer or a solicitor.

    Does anyone have any recommendations for a conveyancer? I’d like to make sure it is done properly. Thanks, John 🙂

    You may be able to submit it on paper, there should be a facility for that, just tell them you want paper copies of the transfer forms as you wish to submit it by post. I’m not in NSW but NZ, as far as I know lawyers will probably not deal with unregistered trusts, but you can go to community law (if you have those in your area) and get some free legal advice. They may even know where a conveyancer is. I learnt to do my own paperwork for transferring a property and now I am in the middle of transferring ours to our trust in NZ. They don’t make it easy here, but I have just made some corrections they asked for in a Notice of Requisition (the Requisition Notice puts the transfer on hold until the matters they mention in the Notice have been resolved) and challenged some of the other things they are asking for that are not valid.

    If your trust is registered then a lawyer will do it for you for a price.

      My trust is private. One that Mark made for us. The NSW Land Titles Office have said that they have moved to electronic submissions only now – no other option. You have to make changes through a conveyancer or a solicitor who has access to PEXA.

      I’m looking for recommendations from members who have used a conveyancer or a solicitor to successfully transfer/purchase a property in NSW to their private trust.

        I have heard Mark say, they have to provide you with a paper copy if you ask for it.

          I just called the NSW Land Titles Office again today and a second person there confirmed that due to legislation passed in October 2021, they will only accept electronic lodgement of forms, through a system that is only accessible by licensed conveyancers and solicitors.

          I asked if I could come into the office in person, but was told that it wouldn’t make a difference.

            See them as offers. You have the right to do things on paper. Contact the CEO if you have to and request a paper copy from them. Go to the top!! Alternatively have you tried printing out their online electronic papers so you can fill them out by hand?

            How does that legislation apply to you? Did you agree to be bound by that? If you read the Acts the only entity it states is bound by it, is the Crown.

              I appreciate what you are saying Morag, but my original request was for a recommendation for a NSW conveyancer.

              I am happy to try a different approach if someone in NSW has recently and can share with me their strategy?
