  • Notice sent but stuck in transit. Can I send second Notice?

Posted by J on January 5, 2024 at 12:29 pm

First notice sent via registered post but it has not been delivered (AusPost’s fault), seems to be stuck in transit.

I innerstand that under the BOE act, an exchange of possession of the letter from my hand to the intermediary of Australia Post qualifies as constructive delivery (and therefore constitutes delivery), but does the BOE act apply to the scenario of delivering Notices for the 3 step process?

Can I send the second demand notice even though the first notice hasn’t been received by police?

    thanks

Wouldn’t it be better to use ‘comprehend’ instead of ‘innerstand’ which is not a word in the dictionary but a combination of two words and isn’t it only referring to spiritualism?

Ok I see. why does it say at the end “is there a reason you are not using email”?

Maybe I could just email the first notice to the Police and then send the second one properly via registered post? Do you think email suffices?

Or do you think it’s better to start from scratch and send the first notice again via registered post than to use email?

yes you could send emails. There is an email notary service called readnotify, and if you pay for this you can track where your emails go and how many times it is opened etc. Here’s some information about it. If you decide to join let me know and I can give you more information about how to use it.

Oh sweet!!! do I still need to print the document and sign manually with red pen for bona fide wet ink signature or can I just digitally sign?

it will be better to scan any documents that are signed by you (and jp if applicable) and send them that way as an attachment to the email.

Make sure you keep proof they have been sent and (if you can) received.
