Settling Credit Card With A4V
If someone could advise me of the next step I would be greatly appreciative. Am dealing with a Westpac credit card.
1. Sent Notice of Tender of Payment (original to Accounts, copy to CFO).
2. Sent Notice of Temporary Appointment as Fiduciary to CFO.
3. Sent Notice to Correct Records to CFO – to reduce balance outstanding to zero.
Have received no replies and balance is still showing as outstanding.
They are now in commercial default?
If so, what is it that I’m demanding in my Notice of Demand to them? I don’t want to threaten them with “Should you fail to ……….. within seven days of the date of this Notice, then it will be taken that You have, again, entered into commercial default and I will issue an Invoice to You for award damages…..” or is that the next step? I’m wanting to settle the minimum monthly payment and also settle the total amount on the credit card (as it is currently maxxed out) so I would like to, hopefully, keep the credit card active and now have surplus credit on same. Don’t know if this is possible – and I hope this all makes sense.
So I’m wondering how do I word my Notice of Demand to them to get them to do what I want?
