    Hello All,

    I now have a trust deposit account – not a current account – but at least it’s a start!

    My issue is that the terms and conditions specify:

    ‘Who can give instructions’

    ‘Sometimes we may agree to let a third party manage your savings account. … We’ll only accept instructions from someone else if:

    We’re required by law – for example a court or other competent authority has appointed another person to act on your behalf. A competent authority may include the Department of Work and Pensions.’

    Options:

    1. ignore – it can’t apply as it’s a non-registered trust.

    2. get them to confirm it does not apply – my draft wording:

    ‘Please note the xxxxx Trust is a non-registered trust so the Department of Work and Pensions or any other government entity has no jurisdiction ‘to appoint another person to act on your behalf.’

    Please can you confirm this clause does not apply.’

    Any advice most appreciated.

    Maybe leave it in but if they try to do it then require them to prove they have any jurisdiction over a private Trust? Another option, maybe cross out what you don’t like on the contract from bottom left to top right very lightly and initial it and then hope they don’t notice when you hand in the contract? The wording just says they ‘may’ and ‘only if required by law’ well the legal system has no jurisdiction over a private trust do they so how can a court legitimately pass that ruling?. If they (the courts or the bank) are making a claim don’t they have to prove it?
