    Hey guys,

    So I know alot of key legal principles and principles of equity are based on scripture, namely verses from the King James Bible which is in every court room as we know.

    So my question is, can it actually be useful to use these in court if a judge is being belligerent or not adhering to these principles (providing it is framed in the right way, in a series of questions)?

    These principles are clearly woven into the court/legal system, but are judges actually taught these scriptural principles? Would they know what you are talking about if you bring them up in court?

    First of all, Courts are run according to court rules.

    second comes the matter you there for , in which (hopefully) the fundamentals and principles your asking about are woven into.

    if you learn the courts rules, in your region, court rules trump the matter ,

    The lawyer I’m being taught by impresses on us to know the court rules, you can knock out the other party for not following the courts rules before you even need to discuss the matter your there for.

    one more point,

    I’ve heard a lawyer complain that equity doesn’t work, when his case wasn’t going well, he asked the judge to consider equity…clearly his last ditch effort to win. judge ignored him.

    if you think about it, equity is our behavior as are the biblical principles,

    if like this lawyer, behave like a rat bag then as a strategy when your loosing complin that things ain’t fair… you’ll come across poorly

    its like Mark says, know who we are, the graciousness, equity and diplomacy will become natural to us..

    bit hippy i know. 🙂

    Hey Kari, thanks for the response.

    Yes, you can point out if the other party hasn’t followed the procedural rules. That’s relatively easy to do, but also will usually only buy you some more time, rather than win the proceeding (unless It’s something really major).

    Not surprised to hear of a lawyer exhibiting that behaviour haha.

    Something I have noticed since researching equity and learning equity through Mark is that there is a lot more to equity in terms of what it is and how to invoke it than what lawyers are taught.

    But yes I agree, knowing who you are is paramount.
