ARR Passport – next step ideas please.
Posted by jp72 on July 5, 2024 at 1:08 pmHolding position: Passport. Greetings all. I received an email (picture attached) from the Passport office and a phone message. I have a certified copy of the application with the ARR Signature; they have accepted payment and are now claiming ARR is a slogan and against the legislation. I can go back with a copy of my Stat. Dec., and the application as they have accepted payment. I am also convinced they will try and refuse. Any ideas on holding my position would be greatly appreciated.

Sorry, this may not be any use to you as I’m in NZ, but I accompanied my 16-yr-old daughter into the automobile association office to apply for her learners’ driver license a few months back and she wrote out her “All rights reserved” autograph on the digital form. They told us the ministry of transport wouldn’t accept that “signature” and to redo it. I told them no man/woman or corporation has the right to dictate what mark we make on a contract. I said we’d be sending through this autograph after all and they shrugged and let it go. The piece of plastic calling itself a license arrived in the post a week later and the ‘All rights reserved’ autograph was all good. I’ll be following your story with interest- so important to hold ground.

if they have taken payment, my understanding of contract law I was taught at uni was that a contract has been created. This also applies to retail sales contract which is formed when you pay for your milk, the store makes an offer by quoting a price, you accept that offer (meeting of minds) and when you hand over the cash the contract is ‘settled’ as the store accepts ‘consideration’ for the milk. Offer, acceptance, consideration. It’s why old lease contracts often had a ‘peppercorn’ rent because contract has to hold 3 principles.
I recently had this with a private parking fine and I tried to make a counter offer to their demand, they sent back the cheque saying as they don’t accept the offer they cannot accept the proposed payment ‘without prejudice’; which is effectively ‘all rights reserved’ because without prej is used to reserve all rights…

hello brandon…would be interessted to see what your counter offer to them was….or a rough idea if u dont want to fully disclose…..so u basically had a win because they refused yr counter offer?

actually it was a loss…i was hoping they would have cashed the cheque sent with my counter offer thereby securing acceptance of it. They didn’t cash it, they sent it back refusing my offer.

Unfortunately, I can’t accept your offer because there is already a contract in place with payment taken.
I attach, for your information, proof of the submitted application, a payment receipt confirming the contract, and a Commonwealth Statutory Declaration of my signature.
To renegotiate the contract, I require answers to the following:
1. Are you claiming that you have the authority to dictate to me how I sign my name? If so, what evidence do you have for this claim?
2. Can you not provide me with evidence that the Australian passports act 2005 applies to a man?

It might be tricky claiming you are a man without an affidavit to prove
it? It might be better to just ask the first question and include your
stat dec to prove that is your normal signature? If you have any other
documents with that signature that would be helpful as well. Here’s some more information you might find helpful?-

It is tricky navigating this stuff just from models at times. Knowing which documentation to have in place to ask certain questions seems important. Is there a table or flow chart that has this consolidated information?-

Thanks, @morag-janet-of-the-hill-family. I completed the Commonwealth Stat Dec and had it signed by a JP. I even had the JP certify copies of the applications with the ARR signatures. The agents for DEFAT – Australia Post – commented that it was a great signature and allowed me to take a photo of the final application with their details completed and payment made. So, I am in no doubt I have a contractual agreement with that signature. They have come back with the 2005 Australian Passport Act – “no slogans in a signature”. I sent a copy of the stat dec and completed form to them today.

i need affidavit for my passport renewal, i do as was suggested the a commonwealth stat dec and a affidavit to support it if im correct, and if you could please give me an example how to sign it i just confuse myself . By : Signature

The statutory declaration should be adequate, you don’t need an affidavit as far as I know.

Thank you very much i really appreciate it . I was thinking once i go to justice in peace to sign the stat dec it would be a smart move to make an affidavit just for my record as i have non . What model need to buy to get a template please?
also should i change my signature as a trustee in the trust documents ? My all right signature was done after my trust?
Just an update
i went back to the post office where the passport renewal was processed and i said im not happy as the passport dosent match with the application . I filled out a declaration that post office provided and they sent it back to the passport office attached to my passport after that
i have received a phone call from passport office and officer said they can not accept it as it is . I have 2 option i accept the passport as it is or i have to fill out a form b11 to escalate the case and provide other documents to support signature . So this is where i am right now .
I have to tell how great full i m to be part of this group without you guys i would be lost

it sounds like you are making all the right moves, just keep on the path you are on. As for an affidavit; affidavits are just statements of fact and are not really of any use unless it is to establish some things with the adversary. They need to be given to another party so that they can become unrebutted. When they are not rebutted they become truth in law and commerce. Therefore when you write an affidavit you need to make sure the facts in them cannot be rebutted. There are two ways of doing this a. it can’t be rebutted because it is self evident eg I am living. b. you have evidence which you present as exhibits to the affidavit.

The affidavit I shared is only partial you need to complete it. But as i said you probably won’t need one for the matter you are dealing with, I just shared it so you could see what an affidavit looks like.

Amazing! Thanks all for keeping the thread alive. There are some important details emerging. @tommy that form “b11” sounds important.
My update – I lost. I needed my passport within a certain timeframe to travel and the stalling an B.S. excuses I was given pushed it to close to my deadline.
1. I had All Rights Reserved overlapping my signature and was toled by the Passport Office that they usually ‘Take the ARR off but overlapping it with the signature didn’t allow them to do that’. Their last excuse was that there are countries who do not accept the ARR therefore they could not issue a passprot that would restrict my travel. I have requested a list of the countries – even the person I spoke to was interested to find out.
2. @tommy I’d love to hear if ‘b11’ gets things over the line.3. The Passport Offce rep told me they are getting more of these signatures since C-19.
Keep sharing and we will be able to put more of this jigsaw together.

Hi all , after successfully getting my ARR drivers license, I now am going to get my ARR passport ( first application)
Is it best to go into passport office or post office to apply ?
