Id like to add a new beneficiary but not quite sure how its done, Im aware of section 13 of the deed and how Im able to do this as Trustee but Im not sure how I make the document to amend the deed and add the new beneficiary.Bonez replied 10 months, 2 weeks ago 3 Members · 6 Replies -

I would think you would have a private meeting with the trustees and principal and make the change there then add the name to the deed with the Deed of Amendment as evidence of that change with all signatures of the above positions attached with the date and time.

Well I would be both of those positions Im just curious how its done, do I draft it up on paper and just attach it to the schedule with a paper clip of some kind?
Im curious as to why we use the birth certificate name as trustee if its written in English in the schedule, can we use an unincorporated entity as trustee instead?
Im just not sure about acting as trustee and using the birth certificate name because Im not the trustee of that birth certificate name.Same with the applicable law why does it say “Commonwealth of Australia” and not “The Commonwealth of Australia” as written in the constitution act?

Yeah it was done by Mark, I only just had these thoughts recently.
Because the name I’ve used for myself on the deed is the whole name including family name in proper English which is the same name I’ve unincorporated and obtained an ABN for so I was just curious if I could use the unincorporated entity as trustee.
I don’t even know how to contact Mark I believe I tried replying to the last email I received from him but it bounced back-
just have a meeting with beneficiaries and resolve it with some minutes……theres plenty of template minutes on internet you could use as a guide…i believe theres even some in the original papers sent out with yr trust deed. perhaps u may consider getting the minutes stamped by JP simply confirming that it is an original document (Its of no business to them what s in the doc…they just confirming its an original doc) ……..u r the trustee with discretionary powers to appoint ….follow the trust deed all the best

Yeah I have the minutes templates, just wasn’t sure if it had to be official like on the Schedule 1 page or a certain way it had to be done
