Hi, I am new to the website and my rights in general, but am really getting my teeth into things, even though it is all a bit overwhelming at times! Anyway I’m jumping in both feet first and contesting the last couple of infringements.

I was served with a Notice to Appear for a speeding fine on Tuesday at the police station and the officer did not sign the form. I know this means he did not serve the notice correctly due to section 384 (f) of the Police Powers and Responsibilities act 2000 QLD. I have the encounter on video which he was notified of.

Question: What should I do next as I believe I have 72hrs to respond to the notice out of Honour of Equity but I don’t want them to be able to just issue another one and get away with stuffing it up. Have I got a good case now to not appear, or should I just appear but do so with the notice and ask the case be dismissed? They say on the form I need to return the notice asap. Cheers.
