Arrested for failing to state details
Yesterday I took Dad out to go to the ATM machine as he cant use a car himself due to having knee replacement surgery last week.
While he was at the ATM and I was sitting in a parked car waiting a Police Officer approached the door out of no where asking “Whats your full name and can you produce your drivers licence?” I started recording, everytime she asked “Whats your full name?” I would respond with “what do you mean by your?” this went on for about 2 mins before another cop approached the car and asked the same question to which i asked again “What do you mean by your?”.
They then proceeded to rip me out the car in front of everyone on a busy street corner, as i was being ripped out the car he aggressively told me i was under arrest, I asked “what for?” and he replied as captured by the recording on the phone “Fail to state details”.In what world do we get ripped out of a car thrown into the back of a wagon, leaving Dad stranded on one leg, for failing to state details.
When i never refused anything, I was just asking what they meant by your.At the jail house i never told them i was a name and i never gave them a date of birth, they would have done some digging and presuming to locate the birth certificate details, which one officer actually brought up when continuing to ask for my name.
They threatened to keep me locked up over night unless i signed a bail agreement to which i said I would only sign under duress and the officer i was speaking to agreed and understood I was only doing so under duress.
For one, the actual agreement was never signed by me, they transferred an electronic marking from one place to the agreement.
Secondly, correct me if im wrong but arent all agreements invalid if one is coerced into entering it?
Thirdly, no name on the agreement just the use of this bullshit wordmark text.
When i asked for all officers details involved in writing they refused and said they are under no obligation to give their details out in writing, they denied having business cards and denied having indemnity insurance.
I had to ask a different officer after being released at the front desk for the details of the 2 officers who ripped me out the car.
I also asked them at the counter what legislation removes an officers obligation to provide details in writing, he said he didn’t know, suprise suprise, so i said well then mate are you sure you know there is no obligation if you dont know the very legislation your claiming to know.Ive observed many many police videos online and never seen anyone get ripped out a car and assaulted so fast for asking a question.
I feel like returning the alleged agreement to the station and letting them know i dont understand what it reads and that a agreement under duress is not legally valid.
I do not plan on going to court, they will have to kidnap me again to get me there…..
