  • Hold position with Centrelink

    I receive Austudy at the moment as I’m studying full time. I just received a letter from Centrelink asking me to call them to make sure I’m receiving the correct amount. They do internal data matching and data matching from government and 3rd parties that can indicate unreported income. If I do not comply (call them) they will stop my payment.

    I have a non registered trust that was created by Solutions Empowerment and have bank accounts open in the trust name. I also trade cryptocurrency through the trust through an exchange and a brokerage and a couple of exchanges outside of Australia in my name. I’m sharing this to cover all bases of their data matching.

    I’m guessing that this might be about some wages PAYG that I’ve earned and may not have reported.

    However I’m not sure what it is about and want to make sure that I don’t accidentally incriminate myself when I call, if they were to ask anything about the trust (Bank accounts or crypto).

    Question 1: From what I know they can’t data match to the trust because it does not have a TFN? Am I correct?

    Question 2: Do you have any wisdom on what I should say if they were to ask about any assets held in trust? I feel confident to hold my position in writing but not so confident if I were to be put on the spot on the phone.

    I want to have all bases covered and feel confident before I call them.

    Also your Trust is in the private domain is it not and do they have any jurisdiction over the private domain. The only things you are compelled to discuss are transactions or income you have done publicly. There is no need to mention anything that they have no jurisdiction over is there? If you were to mention anything that may give them a foot in the door, so you are right about making sure you do not incriminate yourself. It is not a matter of hiding anything or lying or anything like that, it is simply that the Trust and its transactions are not part of their world, is that not so? If you were to ask your neighbour for example what his activities were on his property, would he be compelled to answer or would you, as a person, have no jurisdiction over that part of his life, (unless he had come under your jurisdiction because he was on your property, then you could ask him questions he would be compelled to answer but only on the subject of him being on your property. If he refused to answer then you could ask him to leave could you not)?

      Thanks. You’re a gem. That is exactly what I thought… they have no jurisdiction, and I would never offer information. It’s good to hear you say it, it confirms what I know to be true and gives me more confidence.

    A…Your Trust is completely in the private so there will be no public records of it (apart from what you may have shown to the Bank, but it would be illegal for them to share that information).
