    Looking for some help please. Situation: There is a signed private parenting agreement stating 50/50 split of son’s private school fees (so it is out of family law and now contract). One is fully paid up, the other is behind significantly to the point where the school is threatening to have the child withdrawn from the school (rightfully so). This will not be in the best interest of the child. What can be done in relation to possible ideas around Notices? Or other means to have the fees paid by the irresponsible parent? Thanks!

    Have practical steps been taken, does the other side have the funds to actually pay?

    Are they unorganised with their finances?

    Would they be willing to set up a restructuring plan, consolidate their debts to allow for making payments?

    Would the school be willing to contact the other side putting forward the above suggestions?

    Are you on talking terms with the other party?

    Is it a won’t pay situation?

    Can you find common ground for the sake of your offspring?

    Could you arrange a meeting with the other side and the school to find a solution?

    I’d explore every avenue first.

    Otherwise you can sue for breach of contract but if it gets to that stage then everyone loses.
