Through an acquaintance (lawyer) I spoke with another lawyer and a barrister (a relative of theirs) to help with getting my mums will executed. I constantly asked them if there are fees involved for the letters they wrote on my behalf – their representation was ineffective and bore no fruit. In fact the executors solicitors simply ignored their demands. I was given no estimation of costs, signed no agreements, in fact saw nothing. When I asked was told there’d be a nominal fee. THen just received a $7000 invoice. Love to know how I might word a response …. any ideas, or can someone point me in the right direction?

    Thanks!

Just remember it is an offer and they have no evidence that that is the fee you agreed to. Negotiation would probably be your best bet either in the form of a three step notice with affidavit or alternatively sitting down with them with a witness and a recording device and asking them the right questions eg where is the contract I signed agreeing to pay you $7,000? etc etc. Answer a question with a question. Prepare what you think is a reasonable fee with evidence. You could also plead hardship as most businesses are required to be lenient in hardship cases. You could ask them if they know of alternative ways for them to be paid eg legal aid? These are all just suggestions and I am in no way giving legal advice, just suggestions on how to approach this problem. Do what ever resonates most strongly with you.

Thankyou! we had no contract .. nor were there any estimations. I assumed it was no win no fee type of situation as even though we asked they never gave us any indication of costs. and of course there was no win … fro them. Now however its in my hands. Honestly these lawyers … dont even know what they are talking about half the time! 😂

Btw you are not alone in being done the dirty on by lawyers. Here’s some more examples from people on this forum. It seems we simply can’t trust them.
