00:00:20 Eleni: Q: I called council and spoke to CEO assistant to obtain a meeting and they bullied me into discussing concerns on the phone (I should have held my position) i asked Them 1 question only, if they have to comply with all federal legislation and they just kept saying for me to be specific on which legislation I was referring to and my questions wasn’t a yes or no answer. I asked the same question 3 times then I answered for them. They were yelling at me telling me that I can’t put words in their mouth and terminated the phone call and claimed they were calling their lawyer. I feel like I missed my opportunity to obtain a meeting and I really don’t want to go to court, I did also say on the phone i would bring my credit card but had some concerns and they still hung up. What would you do to obtain a meeting again.

I issued a notice of non consent to council and they still served the notice claiming my notice had no legal effect and they rely on the local government act and don’t need consent. I told tenants that I am handing the matter, not to pay the council and that I have paid my rates. Should I get the tenants to send the notice back? I don’t want them to be bound by silence to be in contract with council. Council will not entertain a meeting with me.

In October 2024, a loan company I served a statutory demand (SD) on (for failing to pay my invoice for defaulting on a Promissory Note sent to them to discharge a home loan) had their application to set aside the SD dismissed in the FCA on the grounds the registrar didn’t have the jurisdiction to proceed and hear the matter because the barrister for the loan company used a loophole in the Corporations Act that doesn’t have any provision in it if the response to the SD cannot be served on the party who served the SD. They pretended there was an issue with the court portal.
Q. Do you think I would be disadvantaged given I have not pursued further legal action against, or corresponded with, the loan company since that court hearing in October 2024?
Q. What next steps would you advise? e.g. write to them and send invoice demanding payment within 7 days? Serve another SD on loan company? Anything else?

If they ignore my notices you advised me to report them to Equifax as a commercial default debtor. I have been on Equifax website and I cannot find how to make the complaint as a consumer. It says to report a company for a commercial default to Equifax Australia, you must be a credit provider (or their agent). I don’t think a consumer can report a company to Equifax. It says that a consumer can report a company to Equifax, but typically only in the context of disputing inaccurate information that the company has placed on the consumers credit report not the other way around. If this is incorrect can you tell me how to report them as I am very confused.
