Government Fear Mongering Against Trusts

On two occasions during the course of 2026, one only last week, public announcements were made by agencies acting for the Australian Government, namely the Australian Taxation Office, that investigations into Trusts would proceed by reason it was asserted Trusts were being used to “avoid” or “evade” various public obligations such as payment of taxes, declaration of various assets and chattel and/or hiding of ownership interests in Real Estate property and other assets.

For thousands of years the “elite” of the world have benefitted from the use of Trusts in protecting their assets, Estate, privacy and cashflows as well as enabling effective Estate planning and more. It’s the key mechanism to protect one’s estate from predatory pirates and any other unwanted or unwarranted attacks on one’s estate, as well as being the platform for the creation of real wealth.

By reason Trusts have been effectively used for so long in Estate planning and protection by the elite and wealthy, more and more common folk have become aware of the effectiveness and benefits of the use of Trusts in their own estate planning and protection.

However, the application of Trusts were designed for and intended use by the wealthy and the elite of society, not for the common man or woman.

There is nothing illegal or unlawful about the use and application of Trusts in everyday Estate planning and protection.

Trusts illegal or unlawful?

If one listens to the fearmongering propaganda espoused by the Australian Taxation Office and other Government and Non Government agencies one could be forgiven for thinking it was illegal to operate business or transactions via a Trust.

Nothing is further from the truth.

Investigation of Trusts

If Trusts are perfectly legal and lawful, it begs the question as to why Australian Taxation Office and other Government and Non Government agencies say publicly they will investigate Trusts on the basis of various claimed causes of action.

This writer recalls an event during the course of 1982 as a young man at that time, sitting in a couch watching the television News program with all the family where the News Reader declared the Government was proceeding with investigating Trusts, the writer’s (step) father arose from his chair and attended the kitchen where he called his accountant from a wall phone and instructed same to close down his Trust.

Do Trusts still remain within society today?

Precisely my point. Every few years public announcements are made by various bodies that investigations into Trusts were proceeding for various reasons but never actually proceed.

Flush Out The Weak Minded Common Folk

The precise purpose of these public announcements and declarations by various public Government and Non Government organizations is to create fear in the common folk that Trusts must be somewhat illegal or unlawful and dangerous so as to cause them to shut down the Trust thereby flushing the Estate and assets of the common folk back into a disposition of no protection or privacy and hence vulnerable to potential and actual predatory attack and plunder by various public interest bodies.

Do you have to close your Trust down when you hear various public (alleged) authorities say Trusts are being investigated for one reason or another? Is there anything to fear by using a Trust for legitimate reasons of estate planning, protection and privacy? No!

Sadly we receive phone calls and emails from Trust clients expressing fear as a result of such public announcements by alleged authorities.

One only needs to “reason” and think logically.

1. How long have Trusts been around and
2. If there was something illegitimate about engaging them why were they permitted to operate for thousands of years before the announcement, and
3. Do the elite and wealthy also have to close down their Trusts, and if not, why not, and
4. What entity for Estate planning, protection and privacy would the elite and wealthy use if they too were barred from engaging trusts/

Trusts will continue to be employed by people all over the world for many years to come. While folks have access to ownership of chattel and property, they will always desire the Estate to be protected. Hence there is never any reason to fear a public announcement of Trust investigation by alleged authorities as Trusts will be needed forever.

We hope this information is useful, is beneficial to you and allays all concerns about public announcements concerning proposed investigations into Trusts. It is only to flush the “common” folk out of the Trust market. Never allow it to concern you!
