    I’d really like to try the A4V process. I have a current SPER debt.

    If I stopped paying the SPER debt instalment, and waited to receive a letter from SPER, Could I then begin an A4V process after I receive that letter?

    I done my first 3 step process for this fine so it wasn’t perfect. I set up a payment plan for $20 a month “as I am under duress and they had threatened me, and provided me with no remedy …….” I recorded the call and created a transcript to use an exhibit later.

    I’m excited to give this one a go now 😊

    I’m guessing I’ll need to order the red ink stamps too.

    I am currently working through the BOE process for a Sper debt. I have completed the last stage and have not received any further correspondence. But the challenge has been to lift the license suspension as they have breached the not negotiable contract (BOE). Holding position is key but how far do you go- no job or give in to them? Once you agree to their terms i.e, payment plan it revokes any previous contracts i.e, BOE, A4V, etc. But need you need to challenge you were under duress when you had to setup a payment plan therefore the contract would be null and void. The fight continues…

    That’s great you have used to B.O.E process 😊. It sounds good they have remained quiet.

    I have the B.O.E module ready to try. I could even try that with SPER instead. I’d like to try each process at some point.

    Q – I’m guessing I’d need to do the same for B.O.E, by stopping payments until they send me a letter?

    I’m hoping the transcript of the call where I explain I was under duress will be enough to challenge them and I will add it as one of my questions in my estoppel.

    I couldn’t loose my licence because it’s listed with the home care package prover for the home care clients I look after, so I just created the plan to keep it.

    Important;

    1. You must have a post office box as it is private, if you use your home address you come under their jurisdiction.

    2. Communications can be challenging as the Customer Rep escalates the call to a Team Leader all have no authority, then you are told to put in a complaint to SPER…

    3. You need to follow each step thoroughly, make sure you have all the info on the BOE and the not negotiable contract, etc…

    4. Holding your position is key as they will attempt to suspend your license and continue to add fees.

    5.This has been a long exercise and if you don’t have someone to support you and who has been through it you will struggle because SPER are quite aggressive and know how to play the game.
