Affidavit Rejected By NSW Magistrate
A friend is fighting a NSW $3000 covid fine. If it had been an infringement notice the fine would have been withdrawn due a recent higher court ruling that the covid infringements gave insufficient detail for the accused to understand what he had done wrong, but in this case he was issued a Court Attendance notice and the fine still stands.
The 3-step commercial process has been completed and the defendant filed a simple affidavit with the court with copies of the letters. This was accepted and filed by the clerk but on the day
of the hearing the magistrate said he does not accept the affidavit and the clerk should never accepted it.My question is: is there a remedy, how do we get around this rejection of our documents?
