    Im not too sure about the arguing part, If you argue that is dishonourable yes that is true, but how does it form a contract. I have read 3 contract law books. which is nothing really in the realm of contract law, but I have not come across that in any of the books. It would be interesting to get more information from Bill about that.

    What I found to be important was; Did the parties create a valid contract? Whether a contract has been formed depends in turn on whether

    1. the parties reached an agreement
    2. consideration was present;
    3. the agreement was legal; and
    4. Did the parties enter into the contract of their own free will, or was one forced to agree under duress or undue influence?
    5. Did the parties enter into the contract with full knowledge of the facts, or was one or both led to the agreement through fraud or mistake?
    6. Did both parties have the capacity to make a contract?
    7. the parties entered into the contract of their own free will, with knowledge of the facts, and with the capacity to make a contract. Number 4 is one of the most important as I have been studying cases of hundreds of people who were terminated for not being vaccinated even when they didn’t say no and or conditionally accepted the offer to alter the stipulations within the existing contract, and how the company managed to terminate them and also have the backing of the FWC was from terms hidden in their contract. One of the biggest no no’s in contract law is you cannot form a contract that is ambiguous in anyway that the other party really has no understanding of what the terms actually mean. Also a new contract must be entered into from their own free will. Did the parties enter into the contract of their own free will, or was one forced to agree under duress or undue influence? A contract is an agreement in which each party assents to the terms of the other party. Without mutual assent there cannot be a contract, and this implies that the assent each person gives must be with reference to that of the other. Recognise that if a person makes an agreement under duress (being forced to enter a contract against his or her will), the agreement is void.
