Bills of exchange process

I tampered to deliver my bills of exchange to the registry yesterday. It was declined.
I posted it registered post.
Domi still need to turn up today for payment. If so, do I only have to give them 1 dollar.

I also have a supposed liability to a non accepted contract with revenue NSW of $36K of a victim restitution order from a court conviction nearly 4 years ago. The first piece of information came in an email form a month ago demanding final payment in 3 weeks. Upon a phone call asking for better and further particulars in a bill form, I was meet with a dumb founded response and directed to lawaccess NSW. There is no appeal process for a VRO and I can’t contact anyone who has the faintest idea what I’m talking about. They are threatening to suspend my licence, which I run my business with and then looking into seizing assets and any land, it’s quite concerning as I am only a novice in this field of discharging debt and communicating with government business’s
PLEASE HELP 😟

You need to do a conditional acceptance three step process accompanied by an affidavit to create an agreement with them that they have no evidence that this is a valid invoice etc. Study the three step Notices that Mark has created to see how this process works. Once you have an equitable estoppel agreement and a private default judgement then it can be used in court as evidence that they have no valid claim, of course you need t study how to hold your position in court as well. If you start a three step notice with affidavit then the courts cannot intervene until that process is over. If you need more in depth help then contact the team for an appointment.

What have we got to stand on that says that court can’t start until this 3 notice process is over?

From what I have learnt you need to ask for an adjournment because of some family emergency or other, it needs to be something you have to attend to which precludes you from being able to be ready for the proceedings and then the judge apparently always allows you to have an adjournment Just make sure it is adjourned for long enough to deal with the emergency.

I watched Mark’s module on the BOE $1.05 process. I am unclear about the BOE section where you nominate a specific address and date and time for them to collect the payment. Are we saying that we will be there waiting with AU$1 or the AU$7 million? Because, what if they do turn up????????

If they turned up to demand real money then we would be able to do the same at the bank with the Bills of Exchange/Promissory Notes the Govt issues. That might be a good reason to not set a precedent. No one including Mark on this site has had anyone turn up to claim the money when given the opportunity, but you must take a private notary with you to record their dishonour/no show so you have a record of giving them the opportunity and them not taking it up. Study all of the relevant webinars and you will learn everything you need to know in this area. Also buy the relevant Modules as they have all the material you need as examples of what to do.

Where do you find a “private” notary? and how are they different to a notary that google search brings up?

You can appoint your own. Module 8 has an example of an abandonment of claim document for a BOE not claimed, you can use, and module 14 has an example of a Certificate of Protest for a dishonoured BOE. I’ve attached another alternative to a Notary as well.
