    Hello Everyone,

    I am brand new, so I am still learning.

    If I don’t ask I won’t know…

    Background

    I have a 20% share in a cattle property – the mortgage has been released (July 2021) as I found out no monies was left owing to the banks.

    Unfortunately I have co-owners (father and step mother) that will not let me use the equity of this property to purchase another property etc, another wise financial independence for myself.

    They refuse to pay any rent for their cattle on my portion of land, they have used me as the guarantor for many years – $18M over 16 yrs…

    I do believe that perhaps I was put into the cattle property as a co-owner from a young age of 19 due to perhaps receiving some trust money from my deceased mother (she died when I was 10 wks old – trying to get this investigated)

    I have a house worth not far off a million too.

    Question

    Is there a way I can transfer my house into a trust, and strip the equity into another trust and earn interest on this?

    And do the same for my 20% share on the cattle property? Transfer this into another trust…

    Instead of going to Court – which will cost millions ..

    If I could somehow strip out $4M worth of equity – and earn the interest on this – then I could use this money to invest into shares and then it doesn’t matter if I don’t get paid rent…

    Here’s some information, it doesn’t answer your question but it does fill you in on how a trust works in business. Do you understand that a Trust has to have three parties to be legitimate? two trustees 1 principal and 1 beneficiary that is not a trustee, at least. I’ve got lots more Q and A’s about trusts generally if you want to see them.

      Appreciate the help and I have a bit of an understanding, re trusts and understand the “private trust” cannot loan,

      Perhaps I am not understanding something here, but I am asking if I can either strip or sell these million dollar assets (no debts) and earn interest on them?

      Meanwhile the value of the properties keep going up in value and can strip out more later if required ?

      The way they are – I cannot use them, so it’s frustrating…however if I can find a loophole around the loophole and then I can either park this equity into an interest earning account or invest some into an index fund….

        If you buy a trust from Mark you have a 1 hour appointment where he will answer all questions in depth.

          I asked in the meeting last night and Mark thought I had to get the co-owners to sign…that’s my issue is the co-owners ….it’s held as tenants and common, which is no different to a share in a company, is my understanding.

          I just need to know if this is possible as then I am happy to spend over the $1K to purchase a ‘private trust fund’…

            Maybe go to the next Q and A and ask a more in depth question there? Be very specific about what you need to know, get there early and put Q… before your question so Mark can see it easily. If you have further questions you’ll have time to ask them once the first question you have is answered.

              Is Zoltan the retired lawyer – still available and are we allowed to know how long is our session for $250?

              Yes he is but he doesn’t deal with the private side, he is more for people going through conventional public processes.

              Do you know how long the session is for $250?

              Have you had other clients that have had this issue or the same question, as I haven’t been able to find this in the forum, at this stage.

              No I have never seen this question before, but similar where other people were involved in a property and Mark said the same thing to them that all parties need to be in agreement to be able to proceed. One remedy could possibly be to create a private agreement with them using the three step notice process?

              Understand re private agreement – I cannot get them to the table on anything.

              I enagaged with lawyers, however they have invoiced me over $600k and they have not got them to the table….the lawyers are just sharks here…

              Hence if I could just get the equity and use it for myself even if through trusts or whatever, I then can move on ….

              Yes well then maybe an appointment with Zoltan could be of value to you then. BTW Lawyers are generally there to protect the system and I have heard other cases where they drained bank accounts through litigation and then left the client high and dry. Not a nice profession. Luke 11.46 Woe to you lawyers as well!! For you weigh men down with heavy burdens hard to bear while you yourselves will not even touch the burdens with one of your fingers.
