Trying to find the name of the REVENUE NSW CFO. Have been sleuthing around the internet with no luck. It would be useful to have for module 8 (Promissory Note) to discharge a fine. If I can’t find a person, can I nominate the CEO for the Appointment
    of Fiduciary?

    Cheers!

There’s a Q and A tonight you could ask there.

You could try an ASIC search. I would expect a CFO to be listed.

Good idea! I didn’t think of that. I had to send off my letters already but will check it out next time.

On an unrelated topic, Promissory Notes ?

In reading what I’ve found so far on this site, I haven’t found any material explaining what the benefit is ?? ie If it’s an infringement, I still end up paying and losing points – Have I missed something – what is the point.??

I believe the point to learning how to use these instruments is so we can take charge of our own affairs and not be constantly financially drained which stops us being able to get a foothold for ourselves and our offspring. I don’t believe it means we will have success only journey. it takes times to become a master craftsman and believe me this is on a parallel plane. I have been studying for three years and I am just starting to be able to see the bigger picture. I liken it to learning a musical instrument, some people learn very fast and have a natural inclination towards playing others (like me) can take years to feel confident and relaxed where playing now goes into the realm of auto pilot and once there you can really start to enjoy the skill you have gained. So a lot of trial and error and patience is needed.

The image reminded me of this talk, it expresses the same idea in terms of the developmental psychology research of Dr Clare W Graves. basic premise is that stress forces us to evolve, then he goes deeper… if we were to understand that this process is normal, then we can approach things with more confidence.

I am using it for a COVID fine. It has been over a year and a half and they suspended my licence twice now. I opted to go to court the first time which they agreed to, 6 months later they turn around and say I am not eligible because I didn’t nominate to go to court when the fine was first issued. This was coincidentally 3 days after the supreme court ruling which led to over 30,000 fines being pulled. I mentioned this in correspondence and not a peep for 4 months and out of the blue they suspended my licence again (thugs!). I chose to use a promissory note to discharge the liability. They didn’t want it going to court so they kept threating my licence.

Did you keep evidence of nominating it to go to court? Does it give you a time limit to do this on their terms? Let us know how your PN process goes please 🙂

I did this over the phone when they suspended it last year. They made me fill out an online form before the reinstated my licence. I think I have an email somewhere.

When the police first issue a fine I think it has the option to go to court.

I find it funny they say I can go to court, make me fill out an online form and tell me to wait for correspondence for a court date and then after 6 months of nothing say I am not eligible.

The second time they suspended my licence I called up and said all I could afford was $50 and asked them to send me a statement of account for my records after making this payment. They pushed so hard to set up a payment plan and only agreed to lift my suspension for 30 days while I sort out my finances. Once I received the statement I turned it into a contract, attached a default and liability clause, did the promissory note and documents and sent it off.

I am waiting to hear back. I think they would be pretty ballsy to re-suspend it… but we will see…

I am preparing the next steps at the moment.

Great you have put in a lot of hard work and that’s what it takes. I would suggest any email correspondence in future it might be a good idea to immediately save any of that correspondence into a folder where you can easily retrieve it if necessary. As long as you have your next optional steps mapped out are taking into account all possible responses and reactions to the process you have just completed then you will be prepared to keep moving forward and directing what happens in this scenario.
