  • Compulsory Purchase Order

    A 3 lane road is being upgraded to a dual carriageway. Work is being done close to the housing area where I live. The labourers are working long hours, kicking up dust, making noise and vibrations going through the land. I attended a powwow held outdoors in my housing area, regarding the dust and noise. The spokesperson mentioned how the local council did a Compulsory Purchase Order (CPO) to buy land behind the housing area. The labourers are working from 7:30 am to 7:30pm, long hours and they may have breached certain boundaries in their work.

    This first meeting of the group are only concerned with the noise and dust problems. Seems like our spokesperson, who explained the situation, has been complaining to different people, organisations, and he seems to be going round in circles. The builders claim that many consultation meetings were set up, but THEY claimed noone from my housing area attended any of the meetings.

    so Initially the group are working towards the dust and noise issues, but can this be taken further? such as a formal complaint, notices to the road builders etc?

    Formal complaints are great, you could start there but make sure what you have in your complaint is backed up with verifiable evidence. You can also start a three step Notice with affidavit in the private with whomever is causing this trespass and disturbing your peace etc.

    I just want to clarify that our local council purchased land situated behind the housing area where i live. a private company is working on the duelling of a 3 lane road located just yards from a house at the top of the housing area. They are also working on a bridge nearby that spans about 80 metres over a gorge.

    I attended a meeting set by the company where about 15 people attended. I took notes of the meeting. The director explained things and took questions. He said there had been misunderstandings between the company and homeowners because this is the only meeting that has happened between the homeowners and them for the 2 and half years that they the company has been in the area, but noone in the housing area had notification from this company directly. The main issues are dust and noise. it now appears that the company has agreed to do something about a rock crusher. some people have experienced, what they believe, is cracks in walls of their homes, from vibrations coming through the rock that the housing area is built on. I have heard a humming noise at night, presumably from the work area. our group spokesman has experience in planning, council or construction work. he spoke about how this company has overstepped the mark and something should be done about it.
