    Hi All,

    So I’ve completed 3 notices and a declaration to Revenue NSW for a camera fine I received.

    During the process I elected to have the fine heard in court to buy myself some time before they suspend my license. Revenue NSW ended up removing the fine and reinstating my licence after I completed the notice. So I figured Yay, win for me!

    Last week I received a court notice of penalty because they apparently had a court hearing for the removed fine without me and want me to pay $700 now. I emailed the court, sent them evidence that the fine was removed and apologised for not being aware that they would prosecute for a fine that had been withdrawn or that I needed to withdraw my court election.

    They replied and claim that the fine was removed because I elected to go to court pending the courts decision, since I didn’t show up they have ruled against me.

    Any advice would be great.

    I’m thinking

    1. send them my affidavit as evidence that they agreed to remove the fine and ask that they revoke the court order

    2. Turn the court order/notice into a contract which makes them owe me $700.

    What do you guys think?

    You can try both of them. I would favour changing the offer/negotiable instrument into a non negotiable contract myself.
