  • Defending against a claim made via a fine print clause

Posted by GalacticHero on August 20, 2022 at 5:13 am

    Hi there,

A financial services company which declared Chapter 11 may initiate a clawback on my property held on deposit thanks to a sneaky 90 day clawback clause in the small print I was not aware of.

Property was withdrawn as there was suspicious activity and possible insider trading prior to Chapter 11.

Property was held in legal fiction.

Any pointers how can I address any potential claims on my property? Would you approach it from the legal fiction or living man angle?

    Thanks
