Director ID – Round 4
Posted by stubbo on December 18, 2023 at 4:59 pmAre there any more specific instructions for Round 4 in relation to all of the exhibits please? The instructions just say to print out and send away. I am really confused about the numbering of the exhibits which seem to conflict with the certified mailing numbers. The exhibits listed on the document list on page 3 jumps from 6 to 16, 17 & 18 and no idea what the page reference numbers are on the right the document list. Do copies of all of the previously sent correspondence get sent again with this affidavit.

With the final affidavit you are listing all of the Notices and affidavit you have sent and the times and dates they were sent and to whom. Then you have copies of everything you have sent as exhibits to the affidavit. I’m not sure what the numbers at the end are either (the ones beside the exhibit names) If you find out can you let us know?

With regards to the exhibits, I unfortunately forgot to take copies of the signed documents for Round 1 and only have the proof of sending for Round 1 (the proof of delivery is now older than 2 months which AusPost says is archived).
How does this effect my Affidavit? Do I have to include the copies and proofs of delivery/send for it to still hold weight? Or can I edit the Affidavit removing reference to the Exhibits?

Did you have a witnessed Certificate of mailing? You could ask the witness to do an affidavit stating they witnessed the signed documents being put into the envelope, then he/she could list the documents they witnessed, you could add that affidavit as an exhibit and also a copy of the witnessed certificate of mailing, which you would have got the witness to do on the day or have you heard of backdating?

I did get the certificate of mailing signed for all rounds, and it was sent in the envelope. So I don’t have a copy of Round 1’s certificate.
Would it reduce the weight of the the Round 4 Affidavit if I didn’t include any of the exhibits?
I do know that Round 1 was received because I got a reply, pretty much the same as what others have received from both ASIC and ABR a long time after the 14 days.

You need exhibits to provide evidence for the facts in the affidavit. Suggestion; If you have a copy of the first certificate of mailing get your witness to fill it out and include a simple affidavit from them to confirm the details on the certificate of mailing are correct. You could use the acknowledgement letter showing the first round was received as evidence/exhibit they received the first round.
